Unlike most of this board I have actually appeared before Justice Engoron before. While, in typical fashion for him, the decision reads like he thinks he is the smartest person in the room and gratuitously chides people, that does not mean it is incorrect on the law.

What I don't understand is how he could rule without a trial. I am aware of summary judgment but I thought only the defense could win that - a ruling from the judge that the plaintiff has such a weak case that no trial is necessary.

I didn't realize a plaintiff could be awarded summary judgment, if that in fact is what happened.

It is a civil matter with discovery, all the cards are on the table, motions by both sides made. It is a non jury trial anyway. Even in a criminal case, there are times when certain defense strategies may be taken off the table by the court before the trial proceeds.

In lay terminology, Summary Judgment means that there is an absence of a material issue of fact on a matter that is to be determined by the trier of fact. That could be on any argument for Plaintiff or Defendant.

To take former President Trump out of this, let’s say you rear end Spider-Pig’s Pinto EV causing it to blow up while he has been stopped at a red light. Spider-Pig can move for partial Summary Judgment declaring that on the issue of liability you are at fault as there was no material issue of fact that he was stopped at a red light you rear ended him.

That's a very good example, not uncommon to sit on a civil jury where the issue of liability is already decided, you are only deciding $$.

No, actually people who really understand things well often give poor examples because they leave out things they know that others don't. Plenty of really knowledgeable folks make poor teachers for that reason.

I wouldn’t consider it as such in this case. While AlM was incorrect, I have seen attorneys cite the 3211 standard on a 3212 motion and vice versa (as well as their counterparts in Federal Court).

I guess it is also how you are taught. In multiple required classes I had in Law School, we were taught of the importance of being able to convey legal concepts to a lay audience. As an example, in the required Professional Responsibility class the professor stressed the importance of being able to explain legal procedure to your client so they can make informed decisions in areas that the rules say that is entirely the discretion of the client.

Also, I took an elective that involved co-teaching with a HS teacher at a local HS an "Introduction to Law" class. Explaining legal concepts to HS students that came from diverse backgrounds really does help in practice. The textbook was also a bit dated. One of the early lessons was assessing the pros and cons of hypothetical "Good Samaritan" laws. The example it used was Kitty Genovese. That really was not something inner city students could relate to. Most would say they would beat the person up. Being knowledgable enough to use Sherrice Iverson and the final episode of Seinfeld I was better able to get them to understand the concept.

Those are good things. Too many people forget their roots and become uber specialized, and it becomes a challenge for them to explain foundation stuff. Medicine is perhaps most guilty of that. But it is certainly not uncommon in the legal profession.

Sounds like he's trying very hard to not gratuitously chide Mr. Trump. I think most judges would have gotten more outraged about the defendant emailing lies about the judge's clerk, and linking to her Instagram account, to millions of people.

I wish people would just come to the basic understanding that the fact that someone might be targeted because of who they are or what they say, doesn't mean they aren't actually a fraudster or criminal. They are not mutually exclusive.
