In lay terminology, Summary Judgment means that there is an absence of a material issue of fact on a matter that is to be determined by the trier of fact. That could be on any argument for Plaintiff or Defendant.To take former President Trump out of this, let’s say you rear end Spider-Pig’s Pinto EV causing it to blow up while he has been stopped at a red light. Spider-Pig can move for partial Summary Judgment declaring that on the issue of liability you are at fault as there was no material issue of fact that he was stopped at a red light you rear ended him. |
