Posted by JayZeeBMT on Sat Nov 21 10:18:49 2020 Accused double murderer Kyle Rittenhouse, who traveled from his Illinois home to Kenosha, Wis., where he allegedly shot and killed two people, plus wounded a third, has made bail and been released from jail.His lawyers, who are also part of the effort to help Trump overturn the results of the recent election, solicited donations to raise the $2 million needed to set their client free. Among those who contributed to this fund was former child star Ricky Shroder. |

He admittedly shot three people and two of them died as a result. The only questions are whether it was murder, self-defense, or something else.The videos that I watched from a couple different angles make a very strong case that it was self-defense in my layman's understanding of what self-defense means. Unless those videos were fake, and I don't think that they were, he's going to walk. |

Despite the fact that two people are dead, bail should be based on whether the accused will show up to Court as well as danger to others as he awaits trial. Considering the notoriety, he is unlikely to be a danger to others because he will be immediately recognized. Not to mention, if his passport and photo ID were turned over, he is much less of a flight risk. |

I'm the wrong person to ask about whether it's normal to get bail when charged with murder or even double murder. It's not something that I have knowledge of at all. This could be very unusual. I have no idea. I was only commenting on how reasonable it would be to consider that he resides in a another state 30 minutes away.I think the fact that he already turned himself in once may indicate that he's less of a flight risk, which is one of the primary considerations. So we'd have to look at people accused of double murder that turned themselves in immediately. As opposed to someone like OJ for example. It would also have to be someone claiming self-defense where that is a reasonable possibility. I know that you see him in videos "hunting humans", but I don't think that's what objective people see. |

Laws in most jurisdictions allow for the judge to consider danger to the community in serious cases. That was one of the primary defects in the original version of NY's bail reform, insufficient allowance for that. Failure to appear is in the same category as flight. |
