Yep, I did find them.

Turns out, the Fourth Circuit court upheld the conviction of someone who accessed a website in violation of the posted terms of service; the majority opinion explicitly stated that damages aren't necessary. The Ninth Circuit court struck down a similar conviction on procedural grounds and remanded the case to the lower court for retrial, but they affirmed that any violation of the posted terms of service is illegal.

So looks like you got pwned again.

In fact, in the Ninth Circuit case the government had charged the defendant with a violation of CFAA but the appellate court en banc rejected the government’s interpretation of the statute. Not only that but one of the judges addressed the issue of TOS violations and ridiculed it as being grounds for finding a CFAA violation.

And in the Fourth Circuit case, the appellate court denied the complaining party relief under the CFAA.

So when you get desperate you make shit up and lie. Congratulations...you've descended from Troll to Liar.

And the 9th Circuit case, which specifically addressed the issue of whether TOS violations rose to the level of a CFAA violation? The district court dismissed on the grounds that the alleged TOS violations failed to state an offense. The 9th Circuit affirmed the dismissal.
