A chokehold was used in taking Garner into custody, a method that is specifically forbidden by the NYPD. The Medical Examiner rules this chokehold to be a cause of Garner's death, making it a homicide. There is clear video showing the actual cop who applied the chokehold causing Garner's death.1. A forbidden chokehold was applied. 2. The officer involved was trained by his department NOT to use it in making an arrest. 3. There is video of him doing exactly that to arrest Garner, an unarmed, sickly prisoner. 4. As a direct result of the use of this chokehold, Garner is now dead. 5. Grand Juries are a prosecutor's forum, and the Staten Island DA had all of this undisputed evidence at his disposal. I have just laid out all the elements in this case, that should have overwhelmingly resulted in an indictment. My nose is an old friend of mine, and it tells me something stinks to high heaven! |

I was brought up to respect the police. My parents were both Holocaust survivors so they knew firsthand what it was like to have law enforcement be against you. They both loved the NYPD because they saw them as being a fair and honest police force dedicated to protecting the public, regardless of race, creed or color.As such, my first inclination in every case is to side with the police. But I agree with you - there should have been an indictment here. This cop was out of control. |

Garner wasn't "resisting arrest", he was trying not to be choked to death. At that, selling loosies is, at most, a violation, not a felony punishable by the death penalty. Now you're in the bar with your babe & some jerk hits on her and you take it very personal. So you wait outside to punish the interloper, & you wind up killing him, thats murder since reason & premeditation exists. Thats the difference Murder requires premeditation. For a murder conviction, it would have to be proven that the cop had a motive/reason to specifically kill Mr. Garner. A prosecutor would be a fool to go for that conviction based on the evidence thats out there now. Negligent manslaughter would be a more credible charge. |
