"After all, blind drunk drivers never intend to kill anyone either."...And they never get convicted of "murder" "Unless the cop were found to have acted with reckless disregard for human life" That still does'nt qualify for a murder charge Simple example, you get into a bar room brawl when a fight breaks out spotaneously, you clock a unknown combatant with a beer bottle & he dies,& you get caught, thats manslaughter. Now you're in the bar with your babe & some jerk hits on her and you take it very personal. So you wait outside to punish the interloper, & you wind up killing him, thats murder since reason & premeditation exists. Thats the difference Murder requires premeditation. For a murder conviction, it would have to be proven that the cop had a motive/reason to specifically kill Mr. Garner. A prosecutor would be a fool to go for that conviction based on the evidence thats out there now. Negligent manslaughter would be a more credible charge. |
