Yep ... even funnier is that the "Pray-TV" networks have even crazier attorneys, and they REALLY mean it with that "morals clause" stuff. Since this assclown wants to play minister on teevee, they should make him sign some of the contracts *I* had to.

But yeah, been there, done that, used the escape clause numerous times to move on to something better. :)

Welllllllllll ... the big "foo pas" I see here is injecting "First Amendment" arguments to broadcast contracts. They're not the government, it's employment at will, and there's a contract that stipulates what you CAN and CANNOT do while working there. Network was perfectly within their rights to suspend under those terms and look at the direction all the butthurt went in. Not one of them having any legitimate basis. He was lucky to just be suspended rather than outright shitcanned.

Correct. You don't have a 1st amendment right to fire someone for violating a contract. You have an Article I, section 10 right.

Even LOGO has "morals clauses" built into their legal paper...I once got a glimpse of a really serious contract involving an A-list star...it was thick like a Manhattan phone directory used to be...no joke.

Mind you, it was for three episodes of a prime time show, as a guest star. What the actual cast had to go through, must have been something to see!

The short, simple version of a modern TV contract is "we owns your arse." That's it, and that's all!

You're unbelievable. You sign contracts evidently with no idea of what you're agreeing to. First lets start with the fact that in the US no one can force you to perform a contract even if it's signed and executed. Sue for damages, of course, but you can't be forced to perform. Second, the language in contracts is often open for debate. That's why people go to court and sometimes lose. Let's see if A&E sues Robertson for breach. Wanna place a a bet?

Balderdash! Easy is correct because his statement makes perfect sense. SelkirkTMO then RESPONDED to Easy's statement, trying to show it to be incorrect. In that context, SelkirkTMO was incorrect because Easy obviously already stated that you would suffer repercussions. Basically, SelkirkTMO just restated what Easy already said and tried to use it as proff as to why Easy was wrong. But it doesn't work that way. Seems to me that, AS USUAL, SelkirkTMO had reading comprehension problems, and that was the basis for his erroneous posting. And I'm being generous at that.

Yeah, you're right. Some contracts you can be forced to perform but in general labor contracts can't be forced. In this case I think that you'd agree that they can't physically silence Robertson no matter what the language is in the contract.

ABC has "DICK CLARK'S Rockin' New Years" show on this year too. I'm waiting for them to wheel him in unless they're going to drop his corpse instead of the ball from the tower. :)

Lemme 'splain. Both bingbong and I were in radio, television and public performances over the years. EACH had contracts with "morals clauses" and others in them, both of us ran afoul of them barely aware that we did. I got suspended several times, and am proud to have been a part of FCC vs. WBAI for playing George Carlin's "Seven Dirty Words" on the ray-dee-oh in alleged violation of my contract. Google Howards Stern and why he's on satellite now ("Fuck the FCC") ... morals clauses make you move to a new station and rarely does it end up in court.

Not ONCE did it make the newspapers, or did anybody sue anybody else. I still had to take two weeks off and google never bothered to report it. So PROFF? Heh.

Do toss some hollandaise on that red herring though, I'll have mine on a kaiser roll. What happened with Dick Dynasty didn't get to court, but it was still violation of the most standard part of every performer's contract. You can even look up the "adverse publicity" clause boilerplate stuff, even google has THAT part. As to what happened to the moron and A&E, they decided to back off because the "adverse publicity" is bringing them new eyeballs right now. Once the eyeballs go away and it becomes a liability to A&E, bookmark this thread. Shithead WILL get fired for violating that clause once Disney stops making money on this publicity.

They *do* ... what the specific requirements of an individual contract may vary somewhat, bringing any kind of "adverse publicity" down on the show can get you shitcanned. Natch, there's Snooki and all, but in the end, what happened to the show?

Those clauses are different for serious journalist types (insanely stringent) but as far as morons with cameras, if you embarass the network and it doesn't raise the ratings as a result, then you get subjected to the "Chuck Barris" clause ... "the ratings are in, and YOU are out." That one works every time. :)

Let me elaborate a little while I wait for another failed compile of code tonight (since I have a little time here) ... THIS is how those "morals clauses" work out in the REAL world of "entertainment industry." You live in LALA land and can probably get free copies of Variety, so you probably know how it works being close to it a WHOLE lot better than the idiots here who are trying to argue it ...

*IF* "adverse publicity" boosts your numbers and eyeballs, then studios and the overseers will completely ignore those bad reviews as LONG as it ups the numbers for a show. And that'll hold AS LONG AS those numbers go up. So you, the talent, and your "benefactor" can cruise along on you shooting up a train, go to jail more often than that child actress who made the papers almost daily a few years ago, and it's all good. Contract absolutely prohibits ANY of that stuff. But as long as you're making money, they'll look the other way.

Until you DON'T.

And when your contract is up for renewal, and your show gets canceled, they'll invoke THOSE episodes as to the reason why you just got shitcanned (Viz: Charlie Sheen whose ratings were STILL holding on, but the producers just got tired of his shit on stage) ... bam! You're gone. Just like what happened with this idiot. Industry also learned that dumping Sheen also killed the program, so they're more careful about that now too.

He's good as long as those numbers keep climbing. But Hollyweird and thebusiness itself have a LONG memory. When those numbers start going down, THIS will be the reason for the shitcan to avoid suits over other speculation as to why the show is done. Folks forget that "make believeland" works under a COMPLETELY different set of rules than a job at Mallwart where you have to accrue three violations of policy with written notes in your personnel file before you can claim "unlawful termination."

Those clauses exist in order to circumvent that "employment at will" when you're a "star" ... they DID suspend him over that, and probably WOULD have invoked that clause to part ways. However, the PUBLICITY (good, bad or indifferent) only caused them to NOT exercise that contract option AT THIS TIME.

If he continues to be a fuckup though, they'll shitcan his ass and no lawyer will be able to extract any more money. Reality shows have even MORE ironclad clauses in them that you would for professional talent, but in the end the ratings dictate what will come of it.

Right now, the ratings are up. You don't EVER fuck with that. But once the curiosity-seekers stop watching, that clause will bite him on the ass as it always does. :)

Uh yeah ... it IS. I can understand the turtle being an expert on everything, but fact is "performers" are what is contracted, even for "Jersey Shore" ... if you're in front of a camera and get paid for it, you *are* a "performer." And you sign a release as well as a contract before you get to go on the air.

This will be my last comment on all this - if Jayzee and those of us who actually worked the industry can't stop people from being stupid about how it works in THIS industry, then can't help youse ...

We HIRED the lawyers and paid them money, not our worry if you hire somebody to handle that. When running a business, it's about the business. Slapping idiots is what you have attorneys to do for you. And all that aside, in SHOW BUSINESS (we did that too) "performance" is the SHOW and those involved in making it happen.

Is it POSSIBLE to consider that YOU GUYS have the terms wrong? PERFORMANCE is what the contracts in show business is about. YMMV.

There is something specifically known as suing for performance of a contract. It has nothing to do with performance of an event, whether artistic or otherwise.

If I sign a real estate contract to sell my house and then refuse to show up at the closing, I can be sued for performance of the contract, and a judge can order my house sold under the terms of the contract even without my signature.

That is what I was referring to. As I said, you can't be sued to perform a tightrope act if you've been injured (or suddenly acquired a fear of heights).

Except that reality TV stars may not have such a clause in their contract because they are constantly saying stupid stuff in the media. Has A&E said that Robertson violated terms of his contract or are you and bingbong assuming?
