Re: ROBBED BY A COP— AGAIN!

In the early 90's, I had taken photos on Grand Central's platforms all the time. It was fun back then, as you never knew what you would see on the front with differently painted FL9's, etc. No one ever bothered you.
Then I didn't do it for years...many years. 9/11 came and went. Back in 2003, not thinking about 9/11, but thinking of the fun I used to have there in the early 90's, took a few photos in the Concourse, and then went onto one of the platforms to take a photo....within SECONDS someone was right behind me telling me I couldn't do that. Not wanting to make a scene, I just said, "Oh Really?", and left. The photo wasn't worth the aggravation. And I had no idea whether it "was or wasn't" legal, but just know that it didn't take more than a few seconds for someone to come up to me.

First and foremost, Nilet, what was the special photo op at GCT that you had to get a picture of? An M1A? M2? M3A? M4? M6? M7A? Shoreliner? Phoebe Snow Cars? Private Varnish?

Irrelevant.

And you could not go anywhere else on MNRR to get it?

Why should he have to?

Secondly, I was also on the ACMU Farewell Trip back in 2004. I remember the lunch stop at Grand Central Terminal. We were told before we arrived that you may photograph ONLY THE ACMU EXCURSION TRAIN!!! DO NOT PHOTOGRAPH ANY OTHER TRAINS ON ANY OTHER PLATFORMS!!!

So what? Employees say a lot of things.

I believe we were informed that it is not allowed on any of the platforms and the exception was for our special train.

Saying it is now allowed is not the same as saying/knowing that it is actually prohibited by law/legal regulation. They were likely feeding us BS to save themselves from trouble.

It was also told because they did not want anybody wandering around where you are not allowed or on trains that were sitting idle on adjacent tracks.

I don't see how not taking photos would prevent either of those actions.

Also, I hate to be the bearer of bad news, but I just spoke to a friend of mine who is employed by MNRR. A higher up you can say. Anyway, he told me that photography IS INDEED ILLEGAL ON ANY PLATFORM OF GRAND CENTRAL TERMINAL for the exception that you are escorted by Dan Bruckner-MNRR President.

Ahaahahahahahahahhahahaahahha! Aahahahahahhahahahahaahhahaahah! Ahahaahahhahahahahaahahha! Aahahahhah. Aahha. ahah. ha.

Um, no. What part of...

THERE ARE NO RULES PROHIBITING THE PHOTOGRAPHY OF LONG ISLAND, METRO-NORTH OR STATEN ISLAND TRAINS AND/OR STATIONS. -- Kevin J. McConville, Chief of [MTA Police] Department

...do you not understand? And what part does your apparently worthless higher-up not understand? And you actually trust this source? How much other BS has he fed you? Oh, and Dan Bruckner is not the MNRR President, lol lol lol lol. You really need to get your facts straight.

Inside the terminal such as in the main concourse-they will not bother you. Also anywhere else on MNRR, they should not bother you.

Bother? This isn't an issue of being bothered or not. People get bothered all the time while doing legal activities. The issue is where it is LEGAL OR NOT. And it is legal.

Yes, they may come up to you and QUESTION you. But they SHOULD NOT bother you as long as you are not a distraction of operation or on another's property. But again, we still hear the stories.

So now there's a well defined difference between "question" and "bother"?

Nilet, I don't want to say this, but the MNRR Employees, MTAPD and Armed Forces were justified with what they were doing.

No, they were not.

You did not help the cause either by brushing them off or by saying it is legal when it is not.

Right, he should have instead lied and said "yes, I am doing a bad thing and yes it is illegal, please stop me". Get real. The terrorists win every time you let the authorities walk all over you.

If you showed the employees a printout of the photography rules, the outcome may have been a little different.

WHAT?!?!? Now you're saying there's photography rules that could have helped him?! But you just said photography isn't allowed in GCT! So how could these rules have helped him then!? You are CON-FUSED.

You are just asking for trouble every time you go out and take photos.

No he's not.

Just to let you know, there is a specific rule applying to Grand Central Terminal ONLY...and you cannot shoot trains there except maybe on your departure track.

Here, I would have to side with the MTA Police. This is not an MTA system rule, just a terminal rule once you get into the actual track departure area...and a longstanding one at that.

You could complain---but your chances of winning THIS one are almost none.

In short, had this been ANY OTHER STATION on the Metro-North system, you may have had a case.

1st off, bring your receipt and stub to court on your appointed date to show the judge. The tresspassing charge is the most important one to beat as it will set you up for the defence you may bring for the photograph issue. If you lose that one, it may set you up for a refusal of a direct order which he/she may believe.
2nd. Stop mouthing off to the police. Whether you are right are wrong, you will always be wrong if you act like an asshole and shit on the police. You lost to them at their own game in front of too many believable witnesses. One of the biggest cheerleaders for photography right on this site will tell you to keep doing it, fight it blah blah blah, and then when he is cornered, says he doesn't have time to pursue it. So since no one here appears to back you, you should protect your own ass, "yes sir" the man and move on.

Terrapin Station: Why must you always have to be such a jackass to every person on this board? Do you really think that you know it all when it comes to where you can and where you can't photograph? Are you some type of lawyer or something? What they hell do you know? Do you have anything else better to do asides harrassing everybody in sight? Every time I read one of your posts, I get more and more fed up with you and your know at all attitude. Get a life and go far away.
I think Bee Flex is completely correct on the issue. Why do you think the reserve is there? For show? Have you ever tried photographing at Grand Central or at Penn Station? And have you ever been in any altercation whatsoever? My guess is a no. Because you're perfect. And you never get into any altercations and you think you know every photography rule there is.
This Nilet is not helping his cause either by getting into altercations. And this nonsense is all because he wanted a picture of some sort of train in Grand Central?! How many times has he been to Grand Central Terminal? Is it his 1st time there? There's got to be something special about whatever he saw that he had to get a photograph of?
And don't you think rules can change? Is there any written proof from the MTA Police Department that you can photograph wherever you want at any place at any time? Why don't you try going to Grand Central Penn Station or any place and photograph every single train in there? Or are you a coward? And if you get stopped, do not come crying here.

So what the Metro-North cops wanted on the trip was to avoid foamers wandering off into the tunnel.

Context: Metro-North understood that foamers, some of them suffering from Aspergers, Autism or generally poor social skills, would flock to this trip and they told the MTA police to corral these obsessives so, while enjoying their trip, they wouldn't male a nuisance of themselves on idled trains.

Having watched what happened o the 9-9-2001 trip to 207 St yard, I can understand their caution.

Its your compliment, I took after you. Perform this simple homework assignment in the morning. Ride Metro North in the morning and bring your camera. Keep your receipts, take one picture of every track there. In fact if you don't feel lucky, since I live near VC Park, I can tag along, and even make a John Doe complaint to the police when you get there so you will guarantee an excellent interview with the MTA police. Tell them how legal it is to take pictures,, challenge them after they tell you to put it away and then you can file a class action with Mr. Nilet. You don't have the balls to do that, just balls to call names hiding behind that monitor and fornacating over Kansas and points north

The only reason that I can think of on why Nilet was stopped and was told that it is illegal for photos is because he may have been in an area where it was not open to the public. From the looks of the pics, the area was not open to the public at that given time they were taken. If the platform was open to the public at the time, then he may have had no problems with taking the photos. I still say that his approach to the employees and authorities was improper.
As far as illegal photos at GCT, my higher up says you can't.
And BTW: What you gave me is regarding LIRR except for the bottom part of the page which I could have used when I had my altercation on the 55 Ave Overpass.
