It's not just about what they didn't want photographed but who they messed with (although I am sure they had no idea).. Carlos Miller is the preeminent photo rights activist on the East Coast. His blog, based out of Miami, is read by other journalists nationwide - he is the one who got the attention of the NY Times when rtype was arrested for taking pictures on the subway last year. |

I think that the guard was within his rights to tell him not to climb on the snow. If someone gets hurt doing that and they might try and sue. They would also be within their rights to prevent loitering in parking lots. The photography comments were of course bogus. |

I have been reading about Carlos' "exploits" and while I am appreciative of his efforts to protect photographer's rights, he seems to be the one who instigates the encounters so that he comes out as the persecuted one. And for the record, at Roselle Park, Cranford and even Linden, police patrolled, but nothing was said to me when I was observed, even where at Linden I was watched by NJT PD, for over 35 minutes and nothing at all was said to me from the second I showed up to the second I left, not followed, not anything!! Here is the letter to me from NJT in it's entirety...... ********************************************************************************************************************************************************************************************************************************************************* Dear Paul, We are replying to your feedback of 2/13/2010 regarding subject: Policies regard photography on the NJT Rail System. NJ TRANSIT allows photographs to be taken of facilities and equipment as long as all safety and security procedures are followed. However, effective January 1, 2006, the requirement for a Photo Pass, temporary or Photo ID, has been eliminated. As such, photo permits are no longer a requirement to take photographs in publicly accessible areas on NJ TRANSIT property. Please note that this pertains to non-commercial photography only. Commercial photographers must still have a contract with NJ TRANSIT if they wish to film or conduct photo shoots. Scout photos taken by location scouts do not require a pass if the photos will not be sold. Thank you for contacting NJ TRANSIT. I was once harrassed by the rent-a-cops at Stamford for taking 1 pic on my iPhone, I showed them my MNR ID and that was the end of it, but when I got back to GCT I notified my boss about what happened and he said he'd pass it along. I went back to Stamford 2 weeks or so later tried to take a pic but this time they said nothing. |

I feel it is the other way around - the authorities are inviting press coverage by continuing to harass and challenge photographers. The solution is very simple - treat cameras like the legal piece of equipment they are and leave photographers alone yet for whatever reason the authorities refuse to do this.As for Carlos - he has personally been involved in 2 major incidents. The first one was the incident that prompted the creation of his blog. He was on a public street taking pictures of a police action - something that anyone (especially the pres) is perfectly within their rights to do. He was arrested and convicted for "resisting arrest" but he won the case on appeal - the trial judge was virtually ripped a new one by the appellate court. He was arrested in a similar incident a year later and that one is currently pending. He pursues stories and tries to get pictures of police action - something photojournalists do. For whatever reason police do not like their picture taken and it seems that they are now going to extraordinary lengths to harass press photographers. I support Carlos because without people like him the issue would not be receiving the attention that it does and by now photography on the subway and elsewhere would probably have been effectively banned. If every photographer challenged authority like Carlos does perhaps the cops and their superiors would finally respect the laws as written and stop enforcing frontier justice on the streets. |

I've called MTA police after heated conversation at Bridgeport, where the Security manager said I had to leave the station because I was breaking the law. In front of him and his employees, the cops told him I could take photos as long as I didn't leave the platform or public access areas. It diffused amicably and I've seen the manager since, but he avoids me now lol. But just to keep things cool, I'll stop by their office and tell them I want to take a few pics and that it's legal blah blah blah and it's been fine there.your pal, Fred |

Look, it's sad that photographers are constantly harassed by the cops, but it doesn't help that so many photographers have this attitude that the Constitution is a legally binding document. If more photographers would just realize that questioning the absolute authority of the police is treason and do whatever they're told with no questions asked, then they wouldn't be harassed. Maybe instead of criticizing cops who are just doing their job, you should be telling photographers not to act like they have a "right" to take pictures just because some god damn piece of paper says that Congress and states shall make no law abridging freedom of speech or of the press.

Here is where I got the ideaI purchased a product - the first sentence in the instruction manual was: "1. remove product from box - do not try to operate it without removing packing material first" So apparently that manufacturer was aware that some customer tried to plug it in while still in the box and before removing the packing material. I am just extending that comcept to the issue of photography - the camera manufacturers are now well aware that 1. governments are engaged in encouraging their police departments to harass photographers 2. harassment causes stress Therefore hold the manufacturers liable for failing to warn. The manufacturers in turn will be forced to defend their products Am I taking it to the extreme - sure :) As long as government is intent on continuing its war against photography I will support all options to fight back |
