Anything self-propelled and running on rails should be FRA class. It's silly to allow transit cars to be exempt.

Many local authorities feel they should be exempt because they do not cross state lines, which is just plain wrong.

Correct, lets be fair, the FAA controls all airplanes, not just commercial right ?? no sepperate rules for light non comercial planes.
So why should transit be excluded from FRA control, no rules, no guidelines, no standards.

It's about time!

I hope it passes, and those agencies that don't shape up, will have there system safety handled for them. It's to bad so many people had to die over the same number of years.

Maybe soon, NYCT employees will NOT be encouraged to respond to active trackways alone, and without an absolute block in place.

Some possible side effects of Federal oversight of local transit systems might be bringing the maximum hours operating employees are permitted to work in line with those on commuter railroads. In NY State, it might also remove the NYCT employees from Taylor law penalties since the Feds have ruled that N-N and LIRR employees are not subject to the Taylor Law but rather the Federal Railway Labor Act.

The FRA doesn't seem to be able to stop Metrolink trains from crashing. I don't see them having any better luck with WMATA or light rail in places like LA and Houston. Still it does make sense to have one standard for safe practice and one group overseeing it.

So they are being less than truthful?

I'd like to see more federal involvement, but less than what is being proposed. The federal government should set guidelines and local agencies should enforce those rules under federal oversight.

They tried that back in 1950. Result was intercity passenger service losing about 20 mph in average speeds . . .

about time to give it to FRA.

I don’t thing that is their ultimate plan. If they were to do so, the FRA would have to draft a different set of safety standards specifically tailored to non common carrier rail transit properties.

I think what Obama administration wants to do is setup a separate agency within USDOT that would have oversight and regulatory authority over public transit enterprises that operate rail passenger service on non common carrier tracks.

The only reason this has become an issue is because the congressional delegation that represents the Washington DC area is pressing the issue. The 06 22 2009 Red line wreck happen to close for comfort.

Senator Barbara Mikulski has been grumbling for some time about that fact that the Tri-State Oversight Committee has virtually no regulatory authority over WMATA.

Actually, I never listen to her. I just goggled the czars and cheats, and her page looked like it had the information I was looking for.

But my post was in answer to a question as to where I got my information or if I was making it up. I get *my* information from Rush Limbaugh, Sean Hannity, or Mark Levin. If you want to poke hole in the thinking of the left, these are good sources, if you want to poke holes in the thinking of the right NYT, Time, Newsweek, msnbc and CNN are good places to start. Those are far more biased than Fox, and this I will say about Rush, I will give you the left's side of the argument before he knocks it down.
