Thank you for your electronic correspondence in which you advised Miami-Dade Transit (MDT) that you would like clarification as to whether or not individuals are allowed to take photographs of the Metrorail system. In your correspondence, you indicate that you were told that you could not photograph unless you possessed a permit.

MDT regrets any inconvenience or embarrassment this incident may have caused you. MDT is not aware of any federal, state, or local law which would prohibit personal photography at our facilities. The incident that you experienced appears to have been the result of the misinterpretation of local county law, specifically Miami-Dade County Code 30(B), which requires permits for commercial photography. MDT also requires permitting for photography when it involves equipment other than a hand-held camera (i.e. tripods, cables/wires, screens, etc.), which could pose a potential safety hazard to other patrons. Although not prohibited, security personnel and/or any MDT employee are encouraged to inquire as to what objects/images a patron is photographing. This is done not with the intent of harassing patrons or station occupants, but rather as a means of ensuring the security of our infrastructure and the general public and ensuring that commercial activity is not being performed.

Miami-Dade Transit certainly acknowledges the efforts of your work. We have advised the MDT Office of Safety and Security and our security contractor, The Wackenhut Corporation, that there are no prohibitions against taking photographs for personal purposes and that the public should not be prohibited from doing so, as long as taking these photographs does not violate Miami-Dade County Code, Chapter 30B.

That won't do any good if the security guard or police officer won't read it and/or doesn't believe it's legit.

Yep, just as I wrote on the day the incident was posted online: No Photo Permit Needed in Miami. His letter even references "Chapter 30B TRANSIT AGENCY RULES AND REGULATIONS" which is one of the three documents I said that I have which proves that there are no restrictions on amateur photography.

The person who perpetrated the latest harassment episode was the very same Eric Muntan who was cc:'d on the email. If he harasses anyone else that email will bite him!! Even if he didn't read it the fact that he was cc'd on it makes him responsible - ignorance will be no excuse when an attorney comes knocking at his door with a subpeona...

Exactly. It doesn't necessarily mean the harassment will stop, but it couldn't hurt! There's no reason to tolerate any of it.

I also sent a letter via postal mail to Mr. Kapoor last week, and am awaiting a reply from him. In my letter, I enclosed a number of photography rules from other transit agencies, which indicated that only commercial photography requires a permit.

In my letter, I mentioned my incident on May 16 at Government Center, and it sounds like Mr. Karpoor may have confused newshawk@gmail.com with me, as it seems like he is apologizing to him for my incident.

Anyway, just as I suspected, Eric Muntan, so-called "Chief of Security," was just blowing hot air.

It appears that Mr Karpoor may be getting lots of letters - once this stuff hits the photo rights sites there is a dedicated following of photographers that drowns the agencies involved with email and snail mail.

Seems that the Wackenhut Corp that provides security for Metrorail has even bigger problems:

Regardless of the outcome of their lawsuit it seems that they will lose the contract as soon as Miami-Dade can find a new security company for Metrorail.

That's where I disagree - the authorities have declared a war against photography and photographers are now fighting back with all legal means at their disposal and that includes lawsuits, the press, organizing, protests, and the ACLU. The photographers rights movements are growing and organizing - we are mad as hell and not taking it any more.

The "National Photographers Rights Organization" will be staging another protest in Los Angeles next week. Stay tuned....

This is where we disagree. There is no war on photographers. It's mostly lots of misinformed people that need to be educated about photographer's rights. Photographers are not even a disenfranchised group, much less victims of a war.

Then why did it take several lawsuits by the NYCLU to finally get the NYPD to issue the directive that was issued last week? Why does PATH ban photography? Why is the DOT systematically harassing photographers in Washington DC? Why were photographers told to "get out of town" by LA Port Police and then threatened with 10 years imprisonment when they called Port Police HQ to complain? Why did the cop force a photographer at Coney Island to surrender his film? I can go on and on and on...

If it were just misinformed people then it would be sporadic and supervision would take the side of the photographer once a complaint was filed. These people are getting their instructions from somewhere and it is those "instructors" that need to be targeted by lawsuits. For example, building managers are actively encouraging security guards to harass photographers. I take a very broad view of the "War against Photography" and apply it not only to government authority but anyone who under color of authority be it private security, building owner or government agency who in any way stops a photographer from engaging in legal activity is engaging in that "war". Incidents are being reported daily across the country and I am working with photo rights groups to help end it.

That you continue to hold this view after what happened to you a couple of years ago...which you described in quite explicit detail, in this very forum...is nothing short of incredible.

Whacking Hut (as we like to call them down here) :) may have more problems. They also hold the security contract for Tri-Rail (the officers do the ticket checking, among other things), and Tri-Rail may shut down sometime in 2011 if the 3 counties it serves (Dade, Broward and Palm Beach) reduce the amount they fund, as they are threatening to do.
