Photos in the subway

A police officer friend of mine who works at 59th St. Columbus Circle told me recently that the regulation about banning photography in the subways is not official - yet. He did tell me that if he gets a call that someone is taking pictures, he and his partner have to check it out - that is what his orders are. He also told me that he thinks that the proposed ban is stupid because there are plenty of pictures already on the internet which have been there for years just for any terrorist to check out at leisure. We agreed that those at the top have their heads in the sand - and seriously need to get a clue.

It sounds like your police officer friend has a good head on his shoulders. There are thankfully still quite a few out there like him.

Let's just all of us here keep our fingers crossed.

Expect the worst.

But still hope for the best.

The proposal is still in the proposal stage. The public comment period has ended but the MTA Board has not yet voted on it. Hopefully it will be voted down.

Today (yesterday by now) I gave an interview to Czech TV, who are preparing a short documentary on the NY subway. The interview was centered on my story of dealing with NJTransit police in regard of taking pictures of HBLR, http://talk.nycsubway.org/perl/read?subtalk=700096 , and on the proposed photo ban. Not inappropriately, one of the questions was, "How would you compare this ban with the practice in the Soviet Union [which is where I come from -- S.]?"

Now here's the fun part. As the cameraman and I got out of the train @ Prospect Park to do some shooting there, we saw the "If you see something, say something" notice. Just as he wanted to capture it... that's right, a security guard appeared from nowhere. "Gentlemen, it is prohibited to take pictures or film here."
-- But [says the cameraman] I'm a journalist, I have my press credentials....
-- With all the things going on here, you know... I have orders from my supervisor. If someone starts doing this, unless you have a permit from New York Police department, I am supposed to call it in. That is, call the police.
That was about the limit of my patience.
-- Now tell me, please, what does Rule 1050.9(c) say? [Heck, I actually learned that number by heart!]
-- What rule?.. What do you mean?
-- Well, if you don't know, I'll tell you. It explicitly says that photography, filming or video recording is permitted if you don't use flash, tripods etc. The photo ban is not in effect yet.
-- Errmmm, I don't know, but I have orders. You can't film... -- now comes the best part of it all... -- at least as long as I'm here!!
(To recall how many times have I heard it in the good ol' USSR! "Go to the other side of the street... it's another district, hence not our responsibility!")
I was actually in a "fighting mood", so if I were alone, I'd probably have said, "Please go ahead, call the police, and we'll go all the way to court. I'll wait." But the cameraman was in a hurry... so we just waited for the guard to go away, he filmed the notice, then we boarded a train and did all the filming we needed @ Church Avenue.

I'm printing out the rule from the website and putting it into my camera bag... and next time this happens (if the ban is not adopted by then), I guess I'll follow the road to the end. It's *almost* fighting the windmills... or, if we are many, maybe not?..

What do you mean by a "security guard"? Do you just mean a random NYCT employee?

The way he sounded, it seemed as if he was on a more-or-less regular patrol. He was uniformed, anyway, and had a two-way radio or something.

SO...... he's asked to enforce a vague rule of conduct that HE doesn't even know WHAT IT STATES/CARRIES??

I assume this incident will become part of the Czech TV report. I hope someone gives the MTA public relations people a copy of it. (Just make sure it's in NTSC not PAL format! :-)

I was thinking - yes a dangerous thing to do at times ,and it seemed to me taht when you go before a judge - and say "I didnt know that was illegal" they say

"Ignorance of the law does not excuse breaking it"

What of the police? Is it fair to ask the court/ police what it says about them, if they are not aware of the laws?

Yes, it is equally fair to ask the same question of the police.

Attempting to enforce a law that does not exist is not excusable, either.

To be sure, I advised the cameraman to make it so (and I will write a followup email to the editor, too). Hopefully!

I hope someone gives the MTA public relations people a copy of it.

They told me they'd give me a video file when it's ready... problem is, the narration will be in Czech, of course.
