Today (yesterday by now) I gave an interview to Czech TV, who are preparing a short documentary on the NY subway. The interview was centered on my story of dealing with NJTransit police in regard of taking pictures of HBLR, http://talk.nycsubway.org/perl/read?subtalk=700096 , and on the proposed photo ban. Not inappropriately, one of the questions was, "How would you compare this ban with the practice in the Soviet Union [which is where I come from -- S.]?"Now here's the fun part. As the cameraman and I got out of the train @ Prospect Park to do some shooting there, we saw the "If you see something, say something" notice. Just as he wanted to capture it... that's right, a security guard appeared from nowhere. "Gentlemen, it is prohibited to take pictures or film here." -- But [says the cameraman] I'm a journalist, I have my press credentials.... -- With all the things going on here, you know... I have orders from my supervisor. If someone starts doing this, unless you have a permit from New York Police department, I am supposed to call it in. That is, call the police. That was about the limit of my patience. -- Now tell me, please, what does Rule 1050.9(c) say? [Heck, I actually learned that number by heart!] -- What rule?.. What do you mean? -- Well, if you don't know, I'll tell you. It explicitly says that photography, filming or video recording is permitted if you don't use flash, tripods etc. The photo ban is not in effect yet. -- Errmmm, I don't know, but I have orders. You can't film... -- now comes the best part of it all... -- at least as long as I'm here!! (To recall how many times have I heard it in the good ol' USSR! "Go to the other side of the street... it's another district, hence not our responsibility!") I was actually in a "fighting mood", so if I were alone, I'd probably have said, "Please go ahead, call the police, and we'll go all the way to court. I'll wait." But the cameraman was in a hurry... so we just waited for the guard to go away, he filmed the notice, then we boarded a train and did all the filming we needed @ Church Avenue. I'm printing out the rule from the website and putting it into my camera bag... and next time this happens (if the ban is not adopted by then), I guess I'll follow the road to the end. It's *almost* fighting the windmills... or, if we are many, maybe not?.. |
