Why do units that deal with employee discipline in major government agencies, sometimes have such misleading, euphemistic names like "Labor Relations". At least in FDNY, when you get in trouble, they send you to the aptly titled "Bureau of Investigation and Trial Services" (BITS). They want people to know this unit's function is to behead employees. "Labor Relations" sounds like workers and management are going to discuss things over tea.

Aha. In my experience, which is purely corporate, "Labor Relations" is the part of HR that negotiates collective bargaining agreements with the unions. Tea is probably available. :)

I still don't know why anyone is sure the woman is an employee.

She was clearly scared sless... Wasn't as easy as it looked, was it?

With my feet the way they are I could not do it either. I fell dow a couple of years ago just walking on the ballast. Cn't dew it anymore.

She was lucky a train didn't wipe her out, what a dumb person.Whenever something crazy like this happens, there is always someone filming it, I wonder if it was a "set-up"?

The weird thing here is she's obviously physically unfit and is having trouble doing this even without the stress of a train approaching. Add that startle factor, and... Then the fam will sue the MTA, and collect.

Should def be charged with trespassing, bc next time she tries that it likely won't end so well.

That's funny. In my company BITS is Broadcast Information Technology Services. Labor Relations handles Union contracts, and HR specializes in harassing high seniority Union members.

Why would the family collect? Can you cite any case where someone who voluntarily puts themselves on the subway tracks has collected (after appeals are done)?

there was a case where some girl on the UES fell on the tracks after a night of bar hopping. She lost an arm. She got a big payday from NYCT because they let her enter the system drunk and it's against their rules to be drunk on TA property.

No. But I think labor relations would like to confront the train on the opposite track.

They will say the T/O on that train should have seen something and brought the train to a stop. There is an obstruction, but I think NYCT would like to confront that T/O.

Maybe the T/O called it in, but when NYCT sees this video they will be mad that the train didn't stop.

Maybe he did call it in once he was stopped, and they told him to proceed and they called the next train coming the other way and told it to enter the station with extreme caution.

Juries often award money. I believe appeals courts always reverse it if NYCT did nothing wrong.

I haven't followed such cases in detail, so I don't know answer to you question with any certainty. I have read that teens who were tagging and injured, one or two killed by normal activity of the subway (not being shot by cops) won cases against the MTA.

I recall the case of a homeless dude who was sleeping on the tracks while rolled up in a bunch of debris (so he looked like a pile of papers), was run over, survived (!) and had a leg cut off. He won several million from the subway. Maybe that was overturned on appeal. I can't understand how that case was won even once, as he was a) trespassing b)reckless and c) the train was operating normally, it didn't exactly jump off the tracks to go hit him. Maybe that one was never paid, but the last I'd heard we the average schucks were out of $2M worth of repairs, maintenance or whatever the MTA would have done with the $$.

As J Average Former Passenger I don't believe the T/O did anything wrong. Contrary to some rule, sure, but not wrong. The train's track is clear, the idiot is 15 feet away and moving away from the train. As a passenger, I don't want to be delayed for that.

Now, had she been stumbling --toward-- the track my train is on, sure, hit the brakes. No matter how stupid/reckless/goofy someone is, I'd rather the train not hit them. In this case, the train is at least serving notice that maybe she should get the F outta there, which she did, at a snail's pace.

(thinks a moment..) then again I don't know where she was when first visible to the train operator. If she was within or moving towards the train's path, then yeah definitely hit the brakes.

Good thing MTA 3rd rail coverboard is so sturdy - looks like she's climbing or even just sitting on it at start of video.

Most properties coverboards are incredibly flimsy, other places like CTA just don't have coverboards (which I kind of agree with, they are tripping hazards.)

OK that lady in the video is very exceptionally, um, physically challenged. She is barely able to step over the running rails and it looks like she reclined for a while on the coverboard. She needs someone to help her up the steps at the very end too.

For most folks who are not so challenged, it is a minor but conscious effort to step over the coverboard.

Excuse me, but why hasn't this woman been charged with trespassing on NYCTA property? It's clear she's not a track worker or other person authorized to be on the tracks.

Plus, the cat may have been on a noble, solitary mission against the alien disease carrying rats invading Gotham City. syrsly, NYC rats were found to have the Plague (probably drug resistant) and infectious virii never before known to biology. Light the Cat Signal!

We gotta get some bigger, meaner cats who can take on city-sized rats. They'll need GMO 1000 volt insulating fur and plague-proof pathogen metabolizing anti-infection systems.

In the few law courses I took, there was always the legal maxim “who wills the means wills the end” so that if a person chooses to drink, then they are responsible for any consequences as a result.

We had a family friend who was a TA lawyer who told me that it is often cheaper for the TA to pay a reasonable out of court settlement than to spend more money to defend against the lawsuit.

The actual purpose of the protection boards is the protect the third rail from snow and ice and not to protect careless employees. The SOP when crossing tracks is to always step OVER rails whether protected or not.

The person did not post it anonymously. It is obvious to everyone who posted it. Even if he takes it down, obviously the NYPD would download it beforehand and it is a crime to destroy evidence.
