I think people re totally confusing the Woodhaven station that is on the still in use Atlantic Branch, and the abandoned Woodhaven station upstairs on the abandoned Rockaway Branch. There's TWO abandoned stations there.

1. There are no obvious restrictions on access to it.

2. There are no people using it who would benefit from exclusivity of access.

3. Many people have been there, with no indication by anybody that they are trespassing. In fact, SubChat often mentions that people living adjacent to the abandoned ROW have claimed pieces of it as their property without dispute.

That would tend to suggest that there is no active private property claim on the abandoned ROW. It's not a certainty - which is why I asked - but it does tend to suggest it.

If you want to know who is responsible for the constant disruptions to the "harmony" of SubChat, look no further than my original post and rkba's reply, followed by the exchange with Train Dude.

I asked: "Is it possible to legally visit the Ozone Park station?" When rkba read this post, his broken diseased mind invented the idea that I was intentionally planning to commit a crime for no reason and began drooling incoherently over his keyboard. Train Dude likely has the intellect for basic reading comprehension in theory, but he's been so thoroughly infected by noxious ideology that he ignored what I actually said and began attacking the criminality/entitlement/whatever that rkba made up.

You know, this country would be much better off if conservatives weren't allowed to vote. We don't let children vote because they lack the intellect and responsibility to handle it— since conservatives aren't any more capable, the same arguments apply. Alas, any method to restrict voting to the sane and responsible would itself be corrupted by the nutters and limiting the influence of the nutters would make voting restrictions unnecessary— a catch-22 no one has managed to resolve.

I've taken a look in Google Street View. Where the ROW is on an embankment rather than a viaduct, there are fences restricting access. I found one gap in a fence that would allow anyone in moderate shape to climb onto the ROW and bushwack their way to the Ozone Park station. There are no "No Trespassing" signs visible.

On the other hand, we know the MTA has the right to exclude people from their property for safety reasons. Is it trespassing if they don't post it but just fence it?

My layman's guess is that you might get arrested but might beat the rap in court because of the lack of signs. But you wouldn't win a false arrest suit because the fence sent an obvious message.

If a property is subject to continuous encroachment, it can't be subject to trespass.

Adverse possession means that occupation of the property without the permission of its nominal owner is so commonplace and has occurred without dispute for so long that the occupant now has greater claim to the property than the original owner. If people living adjacent to the ROW can act like they own it, then that would tend to indicate I can walk down it.

Yes...the words are something to the affect of "openly and nnotoriously" using someone's property uninterrupted. It think in new York state its 10 years for private property. Its much harder for public property. If the chain is interrupted.....such as the owner blocking off for a day or dismantling something you put there.....it goes back to day zero even if you continue to occupy.
That's why private communities often block off seemingly public roads once a year. We have a few of those type of communities on long island where the roads are not town property but instead owned by a civic community. They usually block off the entrances one a year to enforce that claim.

Um, no. Read my original post, where I asked if it was possible to legally access the Ozone Park station.

Now read rkba's reply, where he assumed that asking if someplace is legally accessible is tantamount to trespassing.

Obviously, rkba believes that expressing any interest in a place that might be private property is the same thing as knowingly trespassing on private property. Since you have actually visited an abandoned station, rather than merely expressing interest in doing so, you have necessarily trespassed according to rkba-logic.

The real question here is why any sane person would want to enter an area that has been reported to be infested with poison ivy. For all we know, it probably has chiggers and mosquitos as well. Look what happened to Steve Irwin, and he was a professional. The only good thing I can say about the idea is that the probability of being hit by a train is reasonably low.

This issue was mentioned a couple of years ago when the potential reactivation of the property became a topic of discussion and it was mentioned that the law of adverse possession does not apply to railroad properties so technically those "squatters" are still trespassing.

City Hall (multiple times), Worth St, Brooklyn Bridge Side platforms, 14th St side platforms, 91st St, 18th St, 9th Ave, 42 St lower, Bergen St lower, Nevins St, as well as.....Woodhaven upper, and the list goes on......and all legally. Your assumption that presence in an abandoned station only involves trespassing is absurd at best

I can vouch.....its INFESTED with poison ivy on many parts of the ROW.....which can also be passed in winter months.
