It's empty and there's neither signs nor barriers restricting access, as far as I can see.2. Very relevant— that a property is completely abandoned is evidence that there's no active private property claim on it. 3a. People also brag about perfectly legal activities all the time, with much greater frequency. If this were actually a crime, how come none of the "braggers" have been charged? 3b. "Adverse possession" basically means "I've trespassed so long that it counts as my property now." For adverse possession to be a meaningful claim, the property would need to be abandoned, meaning I'd be free to explore it. If a property is subject to continuous encroachment, it can't be subject to trespass. |
