On the contrary.If people can encroach on the ROW to such an extent that an adverse claim is possible (or would be possible), then the nominal owner of the ROW is not claiming property rights to it, meaning that one can enter it without trespassing. Whether the encroaching homeowners can actually take legal possession of the property through adverse possession is irrelevant to the fact that a transient visitor is not trespassing. |
