It's not definitive, but it is evidence. 3a. This isn't people "regularly get away with it." I have yet to see any indication that anyone has ever been charged. 3b. Adverse possession means that occupation of the property without the permission of its nominal owner is so commonplace and has occurred without dispute for so long that the occupant now has greater claim to the property than the original owner. If people living adjacent to the ROW can act like they own it, then that would tend to indicate I can walk down it. |
