Legitimate Concern...Or More War On Photography?

The NYPD is looking to talk to a man who has lately been photographing children at play in Brooklyn's Prospect Park. The man, described as having "a really nice camera" with a "zoom lens", has aroused the concern of local parents, although his photography in a public place, as the article acknowledges, is completely legal.

Is this legitimate concern for child safety (e.g. "suspicious" photography of children), or another attempt at criminalizing photography? Let me know your thoughts...

I don't think it's WOP so much as the popo responding to a complaint. I take candid people fotos and skip kids since parents are annoyed by it. Someone probably called it in.

I think so, too, someone probably picked up a phone. But still, it does raise some interesting questions...like what happens when you're shooting a landmark, for example, and some kid wanders into the frame. Should one then be obligated to delete that particular pic?

OTOH, unless I woke up in the former Soviet Union this morning, this kind of public photography is still protected under the First Amendment, creepy though it may appear to some...

Do you think there should be legislation prohibiting photography of children not your own in public places? (In other words, a "protect the children" exception to the First Amendment.)

If one can distinguish identity, it's wrong. If it's just kids running around a playground, it's generic. That's OK. If the guy's a pro, it's probably ok (he'd be likely to have some sort of credentials), he understands model releases and all the legal stuff WRT subjects.

No, I would not agree with that BUT I do agree with the police wanting to question the photographer as to his intentions.

NEVER. If you've committed a crime by taking the picture, then it's evidence against you and the police would be incompetent if they ask you to delete it in any case. If you haven't committed a crime, the police can ask you questions but that's it.

It is suspicious. That said, they have nothing to work with as he has not done anything illegal...

I personally now try to avoid taking pictures that annoy people, and since I'm also not interested in having people in my photos it works well.

Tough one. You might be merging common sense with legal statures.
This all depends on your state and jurisdiction too. It reminds me of the cases where people like to photograph girls and such. It is public property.
I couldn't image what he'd be doing with such generic photos. Maybe he was doing survellance? Blackmail? Spying? PI? Espionage?!

Absolutely not. For one, you would technically be committing a crime if you take a picture of your own child and another child is in the frame.

He's most likely a pervert that gets off on kids and that's obviously what concerns people. That it could escalate. Maybe he has a record and has been convicted of molesting kids.

Do you think that there should be legislation preventing police from talking to people? (ie a Constitutional Amendment that prevents police from speaking unless spoken to).

It's not the photograph, it's the photographer. Whats wrong with talking to someone with such an inordinate interest in children that he has been reported by multiple people?

No there shouldn't be. If somebody is hanging around a playground taking pics of kids, somebody is going to complain about it and it will be handled by authorized parties. We can't be chipping away at our fundamental rights.
