However, consider:

1. A state of war was never technically declared.
2. The attacks were on civilian targets.

How can one justify other than a civilian trial using those facts? The terrorists will not go free, because Miranda rights, torture standards, speedy trials, etc., don't apply to those with no legal status in the USA or to those arrested outside the USA.

If they were Mirandised at Gitmo,or anywhere along the way between there and here,they are entitled to a civilian trial. POWs do not get Miranda rights. Since they aren't POWs (they'd have to be members of a standing combatant army to be so) they are foreigners under arrest by the US law enforcement.

Question is, were they Martinized? If so, was it one-hour or three-hour?

The Miranda warning is not given to POWs during a war. Geneva Convention rules apply there.

Therefore they are not POWs. Even bush knew that. Sheesh.

It's not spelled 'Merandized' either. Substituting 's' for 'z' was completely acceptable throughout college. I usually default-use the 's' when I'm not sure and don't feel I want/need/care to check the spelling. This is not a dissertation.

Guantanamo is technically not USA territory either; we simply have a lease on that area with 24 years to go on it (the 99 year lease was signed in 1934 with Fulgencio Batista). But that they were captured outside of USA soil renders any other rights normally afforded to Americans irrelevant.

2. When he realized, as all new Presidents do, that governing is a lot different than being a candidate.

BTW, Bush himself, in 2006, said Gitmo should be closed down and the inmates tried in civilian trials.

Fact is, none of the torture stuff will be in the trial. If the Feds use any evidence drawn out by torture, KSM will move to have it suppressed. Holder said there's plenty of non-torture- driven evidence that the Feds have on KSM..

The real question is why, when other terrorists are being tried via military tribunals, why is holder so determined to try these terrorists in a civilian court? Answer, because Holder wants to make Bush, Cheney, CIA and Waterboarding and not the 9/11 attacks, the realissue. If he loses the case. I haven't really followed it, but I suspect that they want him tried in a civilian court for just the opposite reason. They think that they have a strong case and can get a conviction.

They are now POW's but under Bush they were not, since they would have been entitled to rights under the Geneva Convention. There were 5 stipulations bandied about here, not fighting for an established nation, no uniform etc. Now they've changed their minds.
