I am saying that looking at the current jurists I don’t see any black females who would make a neutral list of most qualified jurists. This is also keeping in mind that President Biden would not put up someone like Janice Rogers Brown even though she is a black female. I will say California Supreme Court Judge Leondra Kruger probably comes closest, but would not put her in that top tier. |

I think as of 2020 only 4 other states had adopted something similar to Kansas. Why, even if that is your intent, would you think that it's a good idea to state that your choice of a Supreme Court Justice would be of a specific race or a specific sex. Why not just say that you'll pick someone eho is highly qualified and then when it turns out to be a black female he can say that she was chosen based only on qualification. "Best" or "most" is highly subjective after all. |

Off of the same Job Posting, HR insisted that a person of a different race be promoted ahead of me only because they needed to promote a person of that race. In the 1983 NYPD sergeant's test a law suit determined that any minority that scored over 50% will be promoted over non minorities. That started the term quota sergeant in the department. I even remember a quota sergeant who said to us not to park in front of fire hydrogens!!Since we never knew anyone's scores the worst were the minority sergeants who scored very high but because of their race were still considered a quota sergeant among the ranks. We had a sergeant who had 2 PHD's and scored very high on the sergeants list but I bet there were a lot of cops who didn't know that and stereotyped him as a quota sergeant. |

I personally like to see that the person either has scholarship that has been cited by the Supreme Court or litigation experience before the Court. I want to see somebody who can point to a case where he/she/they is/are personally opposed to a decision, but must agree with it because the Constitution dictates that result. No person who is honest about following the Constitution can say that every decision they support is perfectly grounded in the Constitution. I also want a Justice that has a very high threshold on stare decisis. What makes you more qualified than the original Justices to determine whether something follows the Constitution? If your only argument is the prior Court misinterpreted the Constitution that should not be enough because then precedent only means the decisions I like are followed. To overrule a prior case you need to demonstrate that every underpinning of the prior decision was wrong such as when the Brown court undercut all justification for Plessy. |
