"We don't have enough facts to discuss the specifics of exactly what happened, but we do know that NYPD's accident investigators have cleared the driver of responsibility. This means that, by inference, that the pedestrian was mostly responsible, at fault, for the accident. What we are missing is the accident report, which would give us the details answering the why and how. The "who" we know already. |

I have to agree with you here, there is way too much speculation on BOTH sides of this. And believe it or not, I am on neither side. I however just can't see one side more at fault than the other, and that's all I have been debating here. |

Since the pedestrian is dead, NYPD did not issue a summons. Obviously I prefer a live pedestrian with a summons over a dead one. |

The articles said he wasn't charged. They didn't say he won't be charged in the future. The investigation may still be ongoing. You have no PROFF that the case is already shut. |
