We don't have enough facts to discuss the specifics of exactly what happened, but we do know that NYPD's accident investigators have cleared the driver of responsibility. This means that, by inference, that the pedestrian was mostly responsible, at fault, for the accident.

What we are missing is the accident report, which would give us the details answering the why and how. The "who" we know already.
