"I however just can't see one side more at fault than the other,"I can. The NYPD's investigation cleared the driver. That leaves the pedestrian at fault. Since the pedestrian is dead, NYPD did not issue a summons. Obviously I prefer a live pedestrian with a summons over a dead one. |
