If she committed the crime of obstruction of justice as defined under Georgia law, she should be convicted of it. I'm sure her lawyers can get an almost totally white jury like the Arbery defendants got, so there's no worry about a wrongful conviction.* She'd only be convicted if the case was solid.* Cynical comment not reflecting my actual views about Georgia juries but reflecting the expected right wing commentary if she were to be convicted. |

My problem is I don’t want to see every case of prosecutorial discretion turn into Obstruction of Justice charge as I said earlier. Speedy trials can only happen because of plea deals on other cases and the only way that will continue is if prosecutors are not worried that the next one they make will turn into trumped up charges against him/her/them. But prosecutorial discretion and obstruction of justice are obviously different things.The former is telling the cops something like: "Thank you for the work you've done, but I'm sorry, I don't feel I can win a case based on the evidence you have provided. Of course, if in your judgment you should continue the investigation, feel free." The latter would require telling the police some kind of false information that would cause them to cease their investigation, whereas without hearing that lie they would have continued to investigate. For example, falsely telling the police "A confidential witness came to me. I can't tell you what they said, but I am very confident that the people you are investigating didn't commit any crime." Neither of us knows whether the prosecutor did the latter or not. |

The business owners testified that they didn't ask for the people to be there, but their testimony was a series of evasive answers, multiple claims of not understanding simple questions, as well as photo and video evidence contradicting their version of events. |
