If the man was truly a paraplegic as he kept saying, the cops could be in for it for forcefully manhandling someone who would be unable to really resist.

Foul-up? Looks like normal procedure. Owensby has prior drug convictions and was seen leaving a drug house. For a sniffer dog to do his work, all occupants of the car must exit. Owensby may be a paraplegic, but he was deliberately stalling by insisting that the officers contact a superior first, and then he acts up while the officers get him out of the car.

You certainly can be crippled and resist arrest. I don't get how some people think that the police have to treat everyone with kid gloves. He was told to get out, he refused and started "the usual" crap, so this is what happens. The police aren't supposed to wait around, pleading "pretty please?" with people.

The police observed them leaving the drug spot, called the K9 o er, got a hit, decided now they can do a more thorough search of vehicle, ordered everyone out, he refused, acting like a perp, and this is what happens.

2. Have developed a level of probable cause that would support the issuance of a Search Warrant, or a warrantless search by an officer.


So what was the level of probable cause that would have supported the issuance of a search warrant?

According to the article: "Owensby received a citation for failure to restrain a child and for having tinted glass as a result of the incident, according to court records." Is a drug sniffing dog is required to verify child restraints and glass tint?

The police claim that it was because they had already called for a drug sniffing dog and their procedure is for the driver to exit for safety reasons.

2 things: First, an auto pulling up, occupant(s) quickly entering and exiting location and going back to the auto raises the suspicion levels.

Secondly, most times, if not all, the Media doesn't know or print all priors. I've seen this throughout my career.

While leaving the car for using a drug sniffing dog might be Dayton's procedure, the officer stated that leaving the car was a precondition for calling his superior.

The article continues: "So you can cooperate and get out of the car, or I will drag you out of the car. You see your two options here?" the officer yells at Owensby, who repeats his request for the officers to call a superior.
Seconds later, two officers grab Owensby, and a struggle ensues."

Obviously, there was urgency in not calling a supervisor.

The police claim that a drug sniffing dog was called to sniff outside the ar. They claim that a search warrant is not needed to sniff the air around a car.

According to Dayton's Police Procedures Section III Subsection D

C. Ambient Air Sniffs
1. A drug detection canine may be utilized to sniff the ambient air around a vehicle on a traffic stop as long as it does not extend the duration of the stop.
2. The vehicle must be turned off during the ambient air sniff.
3. For the safety of the Canine Officer and the occupants, all occupants must be removed from the vehicle prior to the ambient air sniff


Only subsection 1 specifically refers to sniffing ambient air around the car.

Subsections 2 (turn off the motor) and 3 (remove occupant from the car) refer only to ambient air, not ambient air around the car, as does the Section III title. The ambient air for subsections 2 and 3 could also be inside the car.

Subsection 3 (removing the occupants) does not make any sense, if the dogs are sniffing only the ambient air around the car on public property. It makes a lot of sense, if the dogs were called to sniff the ambient air within the car.

Also, if the dogs were called to sniff the ambient air around the car, as per subsection 1, then calling the dogs would have extended the stop. This would violate the prohibition against extending the stop provision within subsection 1.

Either the police officers were violating the extending the stop provision in subsection 1 to sniff the air around the car or they were violating the provision of section B subsection 2 by not having probable cause for a search warrant for a canine search of the car.

The police claim that they could see a child unrestrained in the back seat.

Ah yes, they saw the unrestrained child in the back seat through excessively tinted glass.

Neither did the police officers know of the priors before they stopped Mr. Owensby's car.

First, an auto pulling up, occupant(s) quickly entering and exiting location and going back to the auto raises the suspicion levels.

Suspicion levels are not probable cause for obtaining search warrants.

Let me tell you my suspicions, without any probable cause in this case.

It's well known that drug trafficking requires police cooperation (aka bribes) for its continued existence.

The police in question were had a protection racket with the house occupant. Mr. Owensby was a drug supplier, who just delivered a stash. That accounts for the amount of cash found on his person.

The house occupant had notified the police of the delivery. His payoff for protection by these police officers was his payment to Mr. Owensby. The police would stop Mr. Owensby after he left, take the cash and have the dogs sniff the delivery residue in the car.

These police officers were using their own initiative. Their supervisor wasn't in on this racket. That's why these police turned ballistic, when Mr. Owensby demanded they call a supervisor.

Again, suspicions are not probable cause.

I read other articles, especially those from Dayton sources that have extensively covered this event. The stop was 11 minutes long.

I also watched the video and you didn't or you wouldn't be asking about the tint given that the front windows were open.

You may be correct about the police extending the stop. I haven't read anything about that and I'm not going to play lawyer about laws that I have no knowledge. If he is innocent hopefully he gets a fair trial and gets back his $22,000 in savings that he kept in a bag in his car that police confiscated. Either way, I don't think that they should have pulled him out of his car.
