On the other hand, the prosecutor could have reasonably relied on the cop's representation, which is usually accurate.

1. Who said anything about the premise being invalid. It was a tragic case of mistaken identity.

2. They were supposed to be there in the first place. They had a legal warrant. And even if they didn't they'd still be justified shooting back when being shot at, whether the person shooting at them was justified or not.

3. Who says it was perjury and a fabrication? Surely you don't think the police picked an address out at random just for fun. There had to be a reason they picked that address for the warrant.

I think that people get killed when things are not "done legit", and yes, I think the American people have a reasonable expectation that things like search warrants will be "done legit".

Lying on warrant applications completely defeats the purpose of having procedures like search warrants in the first place.

His claim was he thought they were intruders. It has been stated it was a "no knock" warrant. The biggest problem the city had (and again I have no thought on whether it was true or not) was that falsified information was used to obtain the warrant. That may be the reason why the city settled with the family already. The officers at the scene would very likely be unaware of that if it were the case, and have not been charged.. However, some higher ups may be in a heap, if that proves out.

Like I said, I don't know if it is true or not, the allegations revolved around false statements in the affidavit used to obtain the warrant. It is certainly within the realm of possibility. They sure settled pretty quickly. 12 million is not chump change,

NYC settles lots of these cases, they pay out quite a bit on PD misconduct cases. I have no idea what Louisville PD is like, NYC (by any objective observer) is generally highly regarded as a very good PD. But all it takes is one, and they will garner all of the attention. I would find it very hard to believe that anyone who worked any job, not just PD didn't run across at least a few that don 't belong. And it is pretty much expected on any job (again, not just PD) not to sell out your brothers/sisters except in the most egregious situations. It is more difficult today because camera phones and surveillance tapes are everywhere, and everyone second guesses everything, the benefit of the doubt is gone. Some of that is probably good, phony stories are much less likely to fly, but it's probably gone too far, it causes people to not want to act, even if they were right, for fear of scrutiny.
