A Queens NYPD cop with an extensive history of misconduct complaints and lawsuits has now been busted on evidence tampering charges, authorities said Friday.

Police Officer Kevin Martin, a 14-year veteran of the NYPD, was arrested Thursday and charged with official misconduct and tampering with physical evidence.

A law enforcement source said Martin allegedly vouchered evidence on March 1, 2019 with his body camera off, then turned the camera on after to record the evidence — screwing up any chain of custody, the source said.

He was given a desk appearance ticket and is expected to answer the charges in Queens Criminal Court on Oct. 28, police said.

Martin joined the NYPD in 2006 and is currently assigned to the 109th Precinct in Flushing. An NYPD spokeswoman said the officer was suspended without pay.

Throughout his career, the CCRB has launched 33 abuse, discourtesy and excessive force investigations containing more than 80 allegations against Martin, who is considered one of ten most complained about officers in the department.

He’s also named in six civil lawsuits against the city, three of which have cost taxpayers more than $1.1 million in settlement claims, court documents show.

One of the CCRB investigations involved an improper vehicle search in Flushing on March 1, 2019 — the same day the alleged evidence tampering took place.

It was not immediately clear if the two incidents were connected. The CCRB investigation into the search stalled after the complainant became uncooperative, officials said.

Martin’s lawsuits usually involved false arrests, mostly for marijuana and low-level drug charges. In one federal case settled for $155,006, six different plaintiffs — including freelance TV reporter Francisco Zapata — argued that Martin and 11 other Bronx cops arrested them on bogus marijuana charges in 2011, claiming that the drugs were in plain sight.

Zapata claimed that Martin grabbed him off the street and threw him against the wall, refused to look at his press ID and elbowed him three times in the head as he recovered weed from the reporter’s shirt pocket.

“We got our first idiot of the night,” Martin told other cops upon arresting Zapata, according to court papers.

Another plaintiff, Carlos Nunez, claimed Martin slammed him into a vestibule and accused him of smoking pot even though no drugs were found during a strip search. The criminal charges were dismissed, but Nunez lost his job.

“Our client was a lovely guy. Martin really traumatized him,” attorney Katherine Rosenfeld told the Daily News, adding that Zapata still crosses the street each time he sees a cop.

A Queens District Attorney spokeswoman declined to comment on Martin’s Thursday arrest, saying that the details will be made available after he shows up in court.

The reason I posted this article is that it identified two harbingers of bad behavior that this forum's NYPD's apologists dismissed.

1. Throughout his career, the CCRB has launched 33 abuse, discourtesy and excessive force investigations containing more than 80 allegations against Martin, who is considered one of ten most complained about officers in the department.

It would be nice if a person could be banned from OTChat, while still being able to post on the other chats. I actually like his SubChat posts. For his many faults, he is a true railfan, plus his knowledge as a former T/O adds a lot to the discussion. Over here on HateOTChat it's a different story.

But never going to happen. I don't know if it's even possible to ban someone from one chat only (I admit with no shame that I know next to nothing about website design). I suspect that to do so, each chat would have to be a separate site, and you would have to create a handle for each one. They could still be linked.

ProPublica reports that Kevin Martin had 45 complaints filed against him. 18 were substantiated by the CCRB.

The article does state that NYC is $1.1 million poorer because of the law suits. That information is public record.

I'm waiting for NYPD's disciplinary records to be made, so we can see how well NYPD responds to such early warnings.

The bigger problem is that just about all of Martin's cases that resulted in convictions will be reviewed. Some people who should be in prison may be released because of Martin's "active" policing methods.

When he is arraigned I hope ProPublica lists his hometown. I bet he lives in Suffolk.

Imagine the damage he could do to lives. Cameras protect the innocent from being framed.

From friends who have been ADA’s in other boroughs, if they saw a record as long as Martin’s they likely would not have taken a case to a jury on only his testimony. I agree with BILLBKLYN that anybody can file a complaint or a lawsuit. What if Martin was one of many officers named in a $1,000,000+ lawsuit but the Plaintiff named every cop he/she/they came in contact with and Martin really did not do anything? That being said, this does not represent the 11%. Maybe 0.01% or less.

If his testimony is not reliable, why is he still on the force?

Mr. BILLBKLYN agree on that. We disagree that a complaint that is sustained by the CCRB or a lawsuit award indicates the cop is a potential bad apple.

Neither you nor I have the information to know whether this was the case.

Martin really did not do anything

If there were violence, Officer Martin was obligated to intervene. It should not matter whether that violence were perpetrated by civilian or a police officer. Doing nothing makes a police officer complicit.

That being said, this does not represent the 11%. Maybe 0.01% or less.

That's conjecture. We will have a better knowledge, when all discipline records are subject to public review.

Your own article said he was one of the 10 most complained about cops. As far as lawsuits it is standard practice to include every police officer the Plaintiff came into contact with. Even if Officer Martin played no role and is not culpable of anything, if he ever appeared at all in the notes, he gets named. No different than medical malpractice cases where you see every doctor who ever saw the patient named even if it might have been the doctor who correctly diagnosed what the issue was.

You said he represents 0.01% or less of cops. Well, 40,000 times 0.01% is only 4. Beware of just putting out small percentages without thought. They can be smaller than you think.
