What do you think of this police interaction?

Posted by LuchAAA on Wed Feb 12 23:28:17 2020

I hope this cop is not on the job but in reality he probably is.

I would say all law enforcement officers should be equipped with cameras.

Was the stop petty? Yes. Is hanging an air freshener from the rearview mirror considered obstructing the driver's view and illegal? Yes.

how he acted during the stop should result in his termination.

That's not what he learned at the academy. I hope the lawsuit results in his termination. Cops like this are a threat to law-abiding citizens. The way he spoke to that kid is criminal.

How so? He asked him questions. Police have the common right of inquiry To ask people anything they want. Of course, the people don't have to answer. There was nothing criminal at all About the way the cop was talking.

How is that fishing? I do admit it's Petty and I would never do that, but there was nothing wrong about that stop. The cop maybe should not have kept on bedroom him about drugs in the car, but even that is not illegal in of itself.

Doesn't happen often, but I have to say I agree with LuchAAA. I think the cop was totally fishing. The fact that the cop continued to ask about drugs and such after the motorist answered and even explained that he doesn't smoke marajuana. Understanding that we have an obligation to be compliant with an officer's (lawful) instruction, this young man seemed to do everything right during that traffic stop, including asking/advising the cop that he was reaching for documents/releasing seatbelt and so on.

I guess my point is... If you're pulling him over for the obstruction violation... He's answered your questions and been totally cooperative. Seems to me that at that point the cop should just do what he decides whether it's issue a warning, ticket or nothing at all, and send the young man on his way. To be honest... Again, I agree with Luch that the cop was unprofessional and he makes things harder for those cops who are doing things the right way.

Yup! I didn't know either as I use to have the hangtag for parking at my job hung from the mirror, until one day I noticed the warning, and now I have it in the lower corner of the windshield.

Wow! I get that the stop was totally within guidelines, and I can be OK with the first few questions, but to drag it out like that was some pure BS. I'm not necessarily calling for the cop to be fired, but LuchAAA, I agree with your sentiment.

I commend Mr. Colbert for his actions (including not allowing his car to be searched), and simply ensuring that he did everything possible for things to not escalate.

What "signs of deception" was this young motorist showing? He did everything right: kept his hands visible, asked the cop if it was OK to do something before he did it, so the cop wouldn't suddenly "fear for his life", and he didn't appear "glossy-eyed" or intoxicated in this sharp, clear video.

That cop is full of shit, saying he takes "everybody" he stops out of their car. Officer Max was looking to throw another young Black man in jail from the moment he pulled that car over. Do you really believe a white guy in an expensive suit driving a luxury car would have been asked SIX times, if he had or smoked marijuana or done cocaine?

The ONLY thing that saved this kid from going to jail was that he kept his wits about him, and followed "the talk" every Black child gets about how to deal with the police, by the time he or she turns 12 years old:

Keep your hands visible at all times
Don't make any sudden movements
Tell the cop what you are doing before you do it; ask permission
Stay calm and speak in a respectful tone

That cop was trying HARD to provoke this kid, or find the slightest excuse to look him up.

I agree.

I'm surprised that the cop didn't call for a dog when the kid refused to let the cop do a search of the car.

Yes, I do believe police dogs can be commanded to "alert" on a car. The commands are usually in German (unless you speak German yourself, how do you really know what the hell the cop is telling that dog to do?)

Cops have been known to plant drugs on cars and people. A whole bunch of them were recently caught doing that in Baltimore. It's not as outlandish as you think.

The cop in this video was spoiling to arrest that kid, for anything he could. The kid saved himself by his demeanor, and by having the presence of mind to record the entire stop.

I've posted videos of this happening to a white guy in New Mexico. They went so far as to Xray his stomach to see if he swallowed drugs.

I also posted video of a cop arresting a white male for a fake positive test on a meth kit. And the camera showed it all.

This happens to white males too but it does not get as much pub.

In fact, I've noticed cops increasing interaction with white males in recent years.

they do it to white males all the time. If it isn't drugs it's "how many drinks have you had"! It's not a question.

But the issue of "racial profiling" is good for ratings.

I seriously doubt most cops question white motorists as aggressively and repeatedly as was shown in this video. Not only is racial profiling a real thing, in some cities and towns it's department policy.

there is a lawsuit in NJ where a cop did a cavity search of a white male right on the roadway.

The cop "smelled pot" and performed a search down the guy's pants. A lawsuit was filed.

Also in NM a white male went through worse. He was forced to get an xray of his stomach. So he was illegally detained.

Some of these hick towns fund their operations through civil forfeiture. They pull over a car with out-of-state plates, them make a big noise over anything "suspicious" they find, like "improper" amounts of cash on the occupants, false "alerts" by specially trained K-9s, or even "nervousness" of the driver or passengers. Anything to give them "reasonable grounds" to confiscate money, vehicles, or other items of value.

In some cases, if the driver is traveling with children, they threaten to have the kids taken by child welfare agencies because the cops are "concerned" about the children being around "suspected criminals". There are many paths to legalized robbery.

These unfortunate motorists rarely ever see their property again, as it's very hard to prove that any cash they were carrying wasn't the "proceeds of criminal activity", or that their vehicle wasn't "engaged in interstate trafficking".

These small-town police and sheriff's departments have been getting away with things like this for decades.
