For someone whom so many people claim they "never heard of", Smollett is causing quite a firestorm.

An obscure, ordinary man wouldn't generate anything close to this kind of media attention, even if he, like Jussie, brought Trump into it. Even the Tawana Brawley story only ran for six news cycles and that was it (if you omit the Pagones suicide, which may or may not be related to that case).

Jussie, by comparison, has run in the news for 58 full cycles now....just sayin'...

"In a round of media interviews Wednesday, including with the Chicago Tribune, Foxx defended the decision signed off on by her first assistant, Joseph Magats. She said that many of the thousands of similar, nonviolent felony cases her office handles each year are disposed of by alternative means and noted that Smollett’s celebrity status should not earn him harsher treatment."

But given that she didn't actually recuse herself (despite the news media saying she did, and all of us here believing she had until it was reported otherwise, TDS's nonsense notwithstanding), she probably reviewed Magat's decision before he announced it. At least, she ought to have reviewed it, given the publicity involved in the case.

Isn't the office of the US Attorney for the Southern District of NY still involved in the Michael Cohen case even though Geoffrey Berman is recused? I'm not aware that Robert Khuzami has his own spokesperson independent of Berman's.

FTR the news media said that she did because she announced that she was recusing herself. They didn't just make it up or somehow get it wrong as you seem to be implying. It came from her office.

Out of an abundance of caution, the decision to recuse herself was made to address potential questions of impartiality based upon familiarity with potential witnesses in the case,” Foxx’s spokeswoman Tandra Simonton said on Feb. 20.

What was important in my point to Fred is that we all thought she had recused herself, and then it turned out she hadn't. This changed the picture as we would see it. Under our original understanding, she bears no responsibility for Magat's action. Under the revised set of understood circumstances, she does bear responsibility for Magat's actions.

Chicago’s police union has demanded the resignation of Cook County State’s Attorney Kimberly Foxx after prosecutors dropped 16 felony counts against Empire actor Jussie Smollett.

The city’s Fraternal Order of Police and suburban police chief associations in the Chicago area announced a “no confidence” vote against Foxx during a joint press conference Thursday afternoon.

“We are grateful for the top police officials here with one united voice to demand the resignation of Cook County State’s Attorney Kimberly Foxx,” Kevin Graham, president of the Fraternal Order of Police, said Thursday.

Graham said the vote was about more than the Smollett case, but noted that the high-profile incident undermined the public’s confidence in Chicago’s criminal justice system.

But Foxx said Thursday that she is proud of her record.

“I was elected by the people of Cook County to pursue community safety, prevent harm, and uphold the values of fairness and equal justice,” Foxx said in a statement. “I’m proud of my record in doing that, and I plan to do so through the end of my term and, if the people so will it, into the future.”

Smollett was indicted by a grand jury on 16 charges of felony disorderly conduct after allegedly lying to police about being the victim of a racist and homophobic hate crime on March 8. The actor told officers in January that masked men hurled racist and homophobic slurs before beating him.

Chicago police said after interviewing two brothers identified as persons of interest in the case that Smollett paid the brothers $3,500 to orchestrate the attack.

A little more than two weeks after the indictment, prosecutors dropped all the charges against Smollett in an unannounced court hearing.

The court filing on Smollett has been sealed.

The North Suburban Association of Chiefs of Police in a letter Monday accused Foxx’s office of ignoring crime “regardless of any collateral cost.”

“The fact that you and your staff have made these decisions without consultation with our departments undermines any statements you have made that the Cook County State’s Attorney’s office is working with us to maintain safe, crime free communities,” the letter stated.

Foxx had recused herself from the high profile case before Smollett was charged and handed it over to her deputy, with a representative of her office saying at the time the recusal “was made to address potential questions of impartiality based upon familiarity with potential witnesses in the case.”

It was later reported by The Chicago Sun-Times that Tina Tchen, a Chicago lawyer and former chief of staff to first lady Michelle Obama, had put Foxx in touch with members of Jussie Smollet’s family days after he told police he was the victim of a homophobic, racist attack.

The Fraternal Order of Police has requested a federal investigation into Foxx’s role in the decision to not prosecute Smollett.

Foxx’s spokewoman, Tandra Simonton, said last month that the Smollett case was treated no differently from the more than 5,700 other “cases for alternative prosecution” that the office has handled in the past two years.

“This is not a new or unusual practice,” Simonton said in a statement.

Cook County State's Attorney Kim Foxx lets Derrion Albert killer off the hook

The family of 16-year-old Derrion Albert wants to know why one of the men convicted in his murder is now free. The 16-year-old Fenger High School honors student was on the way home from school when he was caught in the middle of a gang fight and killed in 2009.

The I-Team has been looking into the Cook County State's Attorney decisions in the wake of the Jussie Smollett case and uncovered that the Cook County State's Attorney Kim Foxx decided not to pursue a stiff prison sentence for one of the attackers shortly after she took office.

Cook County Prosecutors charged four teens involved in the gang melée that led to Albert's death as adults. Three were convicted of murder at trial. One pleaded guilty. All are serving prison sentences.

But one teen, known then as "D.J.", was 14 at the time. Prosecutors say he punched Albert and knocked him down, saying that he signed "his death certificate."

Prosecutors decided to charge him as a juvenile in a special kind of case called an Extended Jurisdiction Juvenile prosecution or EJJ.

That means although "D.J." was convicted as a juvenile, he was also sentenced to 30 years as an adult on the underlying offense of murder. However, that sentence would be stayed and not enforced unless he was convicted of a new felony after being released from juvenile custody.

Albert's family says then-Assistant State's Attorney Kim Foxx decided to go the EJJ prosecution route and explained it to them.

"Kim Foxx kept telling us that was the best way to go, that way we have some kind of, the safety net," said Anjanette Albert, Derrion's mother. "That way if he got in trouble he goes back, that's what it is."

In 2015, 14-year-old "D.J." was now 20 year old Dionte Johnson — out of juvenile prison — arrested and charged with felony Aggravated Fleeing after a Chicago police chase. Court records obtained by the I-Team show prosecutors filed notice that they were "seeking to revoke stay of his adult sentence."

"They said that because he got in trouble now we were going to get the 30 years," Anjanette Albert said.

Johnson was convicted of the felony on November 8 2016, Election Day. The same day that Foxx, who supervised the Albert case convictions, won the State's Attorney's race. Soon after, the Albert family says they were called to a meeting at the juvenile court building.

"They call us down there and tell us that the State's Attorney decided to not pursue the motion," said Norman Golliday, Derrion's grandfather.

Anjanette Albert said they told them that, "Kim Foxx decided not to go any further with this to just, it's over. She's going to drop it and he's going to get out and there was nothing that we could do."

Cook County prosecutors were no longer seeking to enforce the 30 year sentence. Instead, they'd ask a judge for probation.

"One of the gentlemen said that it was determined that he had been rehabilitated," said Golliday. "My face almost fell off my head. I could not believe that the guy actually said that."

Anjanette Albert said she repeatedly called Foxx's office, but Foxx never called her back.

"I felt like she sat in our face, she cried with us, she hugged us and then you turn around and let this murderer, I don't care how old he is, he was convicted of first degree murder. My son is not here anymore and she gave us all this hope and she promised us that this was going to be OK. And it didn't turn out like that," Albert told the I-Team.

The Albert family said they just want answers.

"I would just look her straight in her eye and ask her why? Why would she do that?" said Golliday.

"I don't have anything to say to Kim Foxx," said Albert. She continued, "The person that I thought that she was, her heart, her kindness the way that she was with us in court, that's, I don't never want to see her again. Never."

On Monday morning the I-Team asked State's Attorney Kim Foxx to do an interview or give us a statement in response to our reporting. Late Tuesday, a spokesman for Foxx sent the following statement: "Based on the Class 4 Felony, which carries a sentencing range of probation or up to three years in prison, it was not in the interest of justice to pursue a 30 year prison sentence in this case." The spokesman said they had no personal knowledge of the Albert family asking to meet with State's Attorney Foxx.

Dionte Johnson and his attorney told the I-Team that they had no comment.
