There are filing fees and lawyers need retainers. And you know full well that any discovery demands would be objected to by the defendants, and they would move to quash any subpoenas, and that's if it doesn't just get dismissed and the Plaintiff doesn't get sanctioned under FRCP 11 (or 22 NYCRR 130-1.1 if state court).

Totally untrue. Most tax laws allow for financial audits all the time. Sales tax collection allows states to audit sales figures, just as unemployment, comp and disability laws allow scrutiny of payrolls. So do many other provisions unique to particular businesses (like financial institutions or insurance companies.

Nobody doubts that. But there must be some evidence of wrongdoing that requires the scrutiny. The IRS can't simply come to your house and start going through your receipts and checkbook and financial records. They have to show you evidence that they think something is wrong.

Their subjective belief is all they need to conduct an audit. That being said, it does not look good if they are targeting specific groups of people and repeated bad faith "investigations" may lead someone to file a lawsuit against agency. Whether they have absolute or qualified immunity is a different matter and are not areas in which I have practiced.

My understanding is that they can also do random audits, or audits based on certain selection criteria that they do not need to make public.

Actually, no they don't. In fact, in tax cases, unlike other criminal proceedings, the burden of proof rests with the defendant (e.g. taxpayer).

They keep tax cases in a non criminal civil law setting as best they can (IIRC it's under $10000). You don't get to have rights there.
