Most tax laws allow for financial audits all the time. Sales tax collection allows states to audit sales figures, just as unemployment, comp and disability laws allow scrutiny of payrolls. So do many other provisions unique to particular businesses (like financial institutions or insurance companies. |

That being said, it does not look good if they are targeting specific groups of people and repeated bad faith "investigations" may lead someone to file a lawsuit against agency. Whether they have absolute or qualified immunity is a different matter and are not areas in which I have practiced. |
