Their subjective belief is all they need to conduct an audit. That being said, it does not look good if they are targeting specific groups of people and repeated bad faith "investigations" may lead someone to file a lawsuit against agency. Whether they have absolute or qualified immunity is a different matter and are not areas in which I have practiced. |
