If the city had a strong case, it should have taken Garner's family to trial. By choosing to settle for such a large amount instead, the city admits that they wouldn't be able to convince a jury that Garner caused his own death. Their own employee--the Staten Island ME--stated in legal documents that Garner's death was a homicide, making it pretty tough to prove otherwise in court.The city's Law Department is not full of "bleeding hearts" looking cut checks at the drop of a hat. Many of it's attorneys were there during the tenure of Bloomberg and Giuliani. Diallo's family, and Abner Louima both received huge settlements from the city, just like Garner's family did. |

You know damn well that the quality of the case is not the single determining factor in whether a case goes to trial. By going to trial it keeps more coverage on the case, which New York City obviously did not want. There is a reason civil settlements are inadmissible to prove guilt.The line attorneys in Corporation Counsel office likely have served under multiple administrations, but the final decisions on cases of this magnitude are well above the pay grade of line attorneys. They are made by the political appointees of Mayor “deBlasio”. |

The city doesn't always pay out and will take cases to trial. The lower profile cases like those involving ACS or personal injury/slip and fall in particular they are worse than some insurance carriers. The high profile cases they want to make go away as quickly as possible because they don't want the publicity, not because of guilt. |

Put it this way, when Sean Bell was killed in Queens, the NYPD major case Squad had an active narcotics case on him going, which is a reason why Undercovers were at the scene. Once this happened, Ray Kelly himself gave the orders to not let this see the light of day and that case officially got squashed and was to never been talked about again. Shit happens behind closed doors. Unfortunately we live in a society where Optics takes precedence over reality and fact. |
