If the city had a strong case, it should have taken Garner's family to trial. By choosing to settle for such a large amount instead, the city admits that they wouldn't be able to convince a jury that Garner caused his own death. Their own employee--the Staten Island ME--stated in legal documents that Garner's death was a homicide, making it pretty tough to prove otherwise in court.The city's Law Department is not full of "bleeding hearts" looking cut checks at the drop of a hat. Many of it's attorneys were there during the tenure of Bloomberg and Giuliani. Diallo's family, and Abner Louima both received huge settlements from the city, just like Garner's family did. |
