He lost a possible NFL career and spent 6 years in jail. 6 years in jail because the woman should always be believed. This case, however, originally went to the PDU, and Hartigan was the responding detective, and he also did the interrogations of all five kids. He started out with the presumption that these young men were guilty, it was an easy clearance for a very high-profile case, and the suspects fit an easy stereotype in the minds of just about everyone involved in the case.Hartigan managed to force false confessions out of five people. That's no mean feat. |

That isn't something that lends itself to a simple answer without getting into theories of jurisprudence that a lay audience will likely be confused by. I agreed with the decision in Windsor because I felt DOMA exceeded Congress's enumerated powers. Obergfell is a much closer question because I do believe that this is a matter that is left to the states under our Constitutional system. That being said, I question whether this is covered under the Fourteenth Amendment in either direction. In other words, if a state chooses to permit same sex marriage I do not think the opponents can go to Court to challenge it under the United States Constitution or vice versa. |

So, you think marriage equality should be a patchwork, legal and recognized in one state, but not in another, reverting to the two-tier system that existed before 2015. Separate and unequal treatment runs counter to the language of the 14th Amendment, and I think this is why SCOTUS ruled as it did (correctly l, IMO) in Obergefell. Straight marriages are legal and recognized everywhere in the U.S., no matter where they were performed, or by whom. I see no compelling reason why same-sex marriages shouldn't also enjoy that universality, and I'm glad the majority of SCOTUS thought so, too. |

Equal protection only applies to treatment of citizens within the states, not between citizens of different states. The other issue is whether the right to a same sex marriage is a protected liberty interest. If it isn't then the 14th Amendment does not apply if it is being applied the same (e.g. You can't have a law permitting Lesbian women to marry and not Gay men) |

I do want to clarify that this is my position if I were a Judge and that case was presented to me. It is not necessarily how I would act as a legislator. As a legislator if LGBTQIA want to be as unhappy in marriage as straight people who am I to complain in terms of civil marriage provided that no person or entity with a sincere religious conviction can be compelled to participate in the wedding. In the case of someone like Masterpiece Cakeshop, participation would mean if the couple wanted anything other than a stock cake off the shelf. |
