14th Amendment states in pertinent part:

No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

Equal protection only applies to treatment of citizens within the states, not between citizens of different states. The other issue is whether the right to a same sex marriage is a protected liberty interest. If it isn't then the 14th Amendment does not apply if it is being applied the same (e.g. You can't have a law permitting Lesbian women to marry and not Gay men)
