Accessing a website in a manner that violates the posted terms of service is a federal crime under the Computer Fraud and Abuse Act.

So congratulations. You are now just as much of a criminal as Salaam is.
Not having read the complete Act, I would hope that the "posted terms of service" that you refer to would have to be from the owner/operator of the website and not from a random user. Assuming that is the case, then Dave would not have violated the Computer Fraud and Abuse Act by not following the terms you included in your post.

I think we can be very sure that Nilet is making it up as he goes along. Even if you violate a web site's terms of use, the statute will have some kind of clause about causing financial harm in it.

The Computer Fraud and Abuse Act deals with hacking into computers used by a financial institution or the United States Government; or use of any computer when the conduct constituting the offense affects the computer's use by or for the financial institution or the Government; or which is used in or affecting interstate or foreign commerce or communication.

IOW, it doesn't apply to OTChat.

The CFAA predates the internet. It failed to foresee pretty much anything that happened in the last 30 years.

Nope! The CFAA doesn't require financial harm— any failure to obey a website's terms of service is a felony.

Similarly, the DMCA doesn't require any financial harm, copyright infringement, or other illegal activity; breaking digital restrictions management technology is a felony EVEN if you actually own the copyright to the file you're cracking.

Which means that had I bought a later Nikon camera (which encrypts its RAW files) and used open source software released under a very open license to crack the encryption a third party placed on a file I own, I'd still be breaking the law— the digital equivalent of some random company putting their lock on my house without permission and then asking me to pay them for the key and it's still a felony to break the lock.

That's normally my go-to example for ridiculous laws, but it's a bit tricky to demonstrate on SubChat.

There also has to be damages.
