Both the Fourth and Ninth Circuit appellate courts have rejected this argument unless the act involves the unauthorized accessing of a “protected” computer with the intent either (a) to obtain information, (b) to further a fraud, or (c) to damage the computer or its data. There also has to be damages.Don't pout, little boy....one day you'll graduate from elementary school and will be able to play with the big boys. |
