Assuming that is the case, then Dave would not have violated the Computer Fraud and Abuse Act by not following the terms you included in your post. |

The CFAA doesn't require financial harm— any failure to obey a website's terms of service is a felony. Similarly, the DMCA doesn't require any financial harm, copyright infringement, or other illegal activity; breaking digital restrictions management technology is a felony EVEN if you actually own the copyright to the file you're cracking. Which means that had I bought a later Nikon camera (which encrypts its RAW files) and used open source software released under a very open license to crack the encryption a third party placed on a file I own, I'd still be breaking the law— the digital equivalent of some random company putting their lock on my house without permission and then asking me to pay them for the key and it's still a felony to break the lock. That's normally my go-to example for ridiculous laws, but it's a bit tricky to demonstrate on SubChat. |
