Ergo, you shouldn't be disciplind, fined fired, or jailed for calling someone what they really are, and not what they "think" they are.

You do realize, don't you, that US employers have incredible latitude in firing people for expressing their opinions? In fact, the federal government has taken to firing large numbers of civil service employees, who supposedly have legislative protection, for expressing their opinions.
