Based on whats out there now against Kavanaugh, you couldn't burn a 3 time loser with such a weak case.

There is not the slightest consideration of a criminal prosecution. The only question at hand is whether he has the extremely high ethical standards that are expected of a Supreme Court Justice, higher even than those of the President.
