It depends upon which individuals were affected. For example, if a workplace rule was passed that applied to everyone but only people over age 50 were unable to comply so they were fired, there's a presumption of disparate impact. Now the presumption can be rebutted by presenting facts as to why only people over 50 were affected; that may uphold the rule...or it may not, depending upon the facts and whether a judge buys into the explanation. |
