Many of you might have heard about the lawsuit we filed last fall on behalf of Arun Wiita, a Columbia grad student who was handcuffed for taking pictures in and around a Manhattan subway station. I'm posting in response to Nilet's recent account of his encounter with police at GCT. Nilet, I've sent you an e-mail; please post here if for some reason you didn't receive it. For everybody else, the NYCLU is interested in knowing about any experiences you have being harassed or detained by police while taking photographs. We know that this problem is widespread and pernicious, and the more stories we can amass to help us prove it, the better for us to create some policy changes. So, if any of you get detained by police while photographing, please let me know--you can email me, call the NYCLU, or post here (listed in descending order of effectiveness). Informing us of what happened does not guarantee you any sort of representation, but NOT letting us know about it guarantees you NO representation. We do pay attention to what's happening on SubChat, so if you post here, we'll probably see it (but I can't guarantee it). AFAIK WD signals are lunarwhites the same as you'd see on A and B1 divisions with a single-shot red/lw timer. They are driven by coded lighting energy (i.e. they "flash"), but they don't deliver a concentrated burst of light energy that a strobe or flash would. As for your interpretation of the photography rules of NYCT, it would appear that by a literal reading you are correct. However, I can tell you that back during the time when a photo permit was required (there are a number of us here who had one), it was clearly understood that flash was prohibited, be it internal or external (and yes, they had cameras with built-in flash even in those prehistoric days). |

In LA a lot of the photography issues are usually handled quietly by the major film studios that operate there... Amateur photographers seem to be frowned upon, ignored, or despised as paparazzi there...NYC OTOH has a lot of amateur / low budget photographers and film makers who have repeatedly encountered police harassment. They united to fight the proposed restrictions last year and have remained united to fight all harassment. It isn't just about rail photography - all street photography is under attack in NY. |

There is a fine line between "arrogance" and physical attack. If you are stopped, you should use your judgment for that situation. Your safety should be your top concern, and generally, the more you can refrain from anything that could get you legitimately arrested, the better. But, you should also be able to voice your protest, and attempt to explain to police that what you are doing is perfectly legal (as long as you know you're right in doing so). Arrogance in standing up for your rights might be okay in many situations, but making any attempt to physically attack an officer is a different story entirely. |

This problem is extremely widespread in "The Most Photographed City in the World." That's why the NYCLU is working so hard to get it changed. They've successfully countered the proposed MTA ban on photography and the Mayor's Office's draconian "permit" rules, so now it's on to getting change at the NYPD.I should mention again that, though I'm working with the NYCLU, I'm still a law student, and NOTHING I say on this message board should EVER be construed as actual legal advice or as any sort of official statement of the NYCLU. Everything I post here is my own opinion or thoughts, nothing more. |
