Having read the e-mail, I have to wonder whether it's a fabrication. The sentence structure is awful, there is at least one spelling error (or typo), and the letter refers to the "New York City Transit Police," an outfit that does not exist and has not existed for over ten years (the e-mail mentions that it is in response to a phone complaint from this month.

FWIW, Eric Durr is for real, and that IS his phone number. And it wouldn't be unusual for folks up here to not know the specific name of the local agency in the city. I've also seen some doozies come out of his press office so that's not a surprise either. I'd personally lean towards it being genuine, but edited by the person who made the copy available to hide their own personal information in that email.

Many citizens, esp. visitors, may not know the difference between transit police and city police or that there used to be a TPD in New York.

There is now a dedicated transit bureau within the NYPD, and it is commanded by a Bureau Chief. Each borough command within Transit is commanded by an Inspector, with individual transit districts commanded by a Captain or Deputy Inspector.

Eric is the press officer with the NYS Division of Military and Naval Affairs. Not necessary for him to know the specifics of the local agencies since his job is merely to act as a news contact for the NYS Natural Guard and such. His information was probably what he remembered in order to speak to a specific individual rather than the media and didn't have the time to go look up something that wasn't relevant to his own agency's mission. It can get like that since DMNA is a rather small office.

Yeah, that's pretty accurate. In the last incident, I didn't have the camcorder on (in fact, I didn't even own it yet, at the time), but they still handcuffed me and deleted everything after I was already leaving as per their orders. The reason: I asked for badge numbers. After that sort of thing, I've always video'd the entirety of every encounter— and keep in mind, there were loads of cops and also soldiers, but no eyewitnesses who could back me up if they decided to press charges or cause damage; I needed that "trustworthy eyewitness" to keep rolling for my own protection— which I explained, though it did no good. I had every right to keep the camcorder rolling for the entire encounter, which the violated.

Actually the original is posted in the photo.net thread I alluded to in the post I made showing the image. The original image was a pdf which I converted to a jpg so I could embed it - I edited out the name/address of the recipient for purposes of posting it here. Potentially. However, I asked a cousin of mine, who is a retired cop. Apparently, if the card was seized (for official police purposes, as opposed to stolen), I'd have gotten a property receipt for it. Then again, he also took my ID, and told me he did, without giving me a receipt...

I don't know about New York, but in Maryland, if you lease property from anyone, it's yours to do what you want. If the MTA leased the property from Argent Ventures, it's the MTA's property do do what they want.

In all the years I've been rail-fanning I've been stopped once. Amtrak police stopped me because i was walking the ROW from Harris Tower to Harrisburg station to see a Vintage PRR loco on a railfan trip. He didn't take my camera, or my memory stick or my battery. He asked that i walk back to the tower, the same way I walked to the station - whatever sense that made.

That's all ever or just by the police? I've been questioned twice by the police (once with handcuffs, etc.) and maybe 2 or 3 times by employees. Several times security guards have told me to stop and twice by a voice over the PA system.

That's all, ever! Period.. And in recent years I've done a significant amount of railfanning, especially in PA. One exception though. Last October I was videotaping on the NS mainline north of Marysville. My friend Mike had his van parked off the road adjacent to a grade crossing and someone's backyard. The homeowner came out of his house and approached us. He wanted to know what we found so damn fascinating that we'd spend hours watching trains. Of course, his house was less than 100' from the tracks so it was no big deal to him. But we were technically on NS ROW and all the engineers did was give us some extra blasts on the horns for the video.

That's cool then. But railfanning freight trains is different than mass transit. Not very many people around.

I've noticed that many of the people that live near freight rail tracks in the LA area are railfans. At least I assume they are. Many sit outside their houses and watch the trains go by and some even shoot pictures and video. Makes sense that a railfan would buy a house near the tracks I guess.

You are correct.

However, but by not turning it off, Nilet was acting more like a reporter than a photographer, and when you do that you risk that the situation will be further escalated which it was. When the TV reporters do that, they are hoping the situation gets escalated because it makes better TV, but in his situation, the wise thing to do would be to turn it off, although he knew they really had no reason to ask.

I fully understand why he wanted to keep it rolling, but when you do that, you shouldn't complain about the result.

No, he had every right to complain about the result.

He had a good reason to keep it rolling, seeing as he gets stopped a lot. The police are supposed to be professional. They have no right to go ape-sh*t just because they don't get their way. They should arrest him if they think they have a just reason to. Otherwise, they should leave him alone.

This was on the Lower Level...

When i was a plumber's apperentice(1995)doing renvoation work in Grand Central forgot which track, two trains sitting there car cleaners going through them the signs in front where of the platforms in the lobby saying "no passengers" and a yellow tape roping it off..

That is about as close as its going to get why would i have to lie??

Dont confuse me with others i say what i mean and mean what i say, i dont play word games or beat around the bush...

In Pittsburgh once I waved at a passing freight and the engineer leaned out his can and waved at me with both hands!

Cute story back in 90 before C/Rs got their radios, I was working the M at the terminal off lunch my leader (red haired guy, about less time than you still there, leaking roofs in the cabs etc) had a defective bracket. He told the RCI, RCI told dispatcher to have the conductor monitor the radio.
