well..he looked as if he wasn't feeling the cop searching his private area..also..we don't know if he paid his fare..

But..look at the size of the cop to this kid..he didn't really have to slam him to the ground..

The kid was holding onto the backing for the poster. what the cop tried to move the kid, the poster ripped from the wall. Seems as though the kid was less than cooperative.

Unless the cop tried to put the kids hands behind his back and the kid resisted. After the kid was wrestled to the ground, he gets up and tries to hold on again. Probably resisting arrest was not a winning move. By the way, WWF is "World Wildlife Fund". You are likely thinking about the WWE which is the Wrestling Organization.

On watching the video again, it certainly looks like the officer took the perp by the arms and intended to cuff him, At the point that the kid grabs onto the advertising sign, he certainly appears to be resisting arrest. I'll take "Guilty" for $1000, Alex.

Sunset Park activists have released a video that they claim shows a New York City police officer “Groping, brutally body slamming then choking a teenager at the 45th Street train station in Brooklyn.”

The video was unveiled at a press conference held by La Casita Comunal de Sunset Park. In it, the teen, 19-year-old Sean Pagan, is seen being followed by the Transit Police officer, then pushed up against the wall and frisked. It is unclear what dialogue passes between the two, but, at one point, the teen squirms and the officer is seen thrusting him to the ground twice.

David Galarza, a member of the non-profit organization La Casita Comunal, filmed the incident.

Galarza said he was on his way home on Thursday evening, July 19, at around 9 p.m. when all of a sudden he saw Pagan being approached by an officer. He followed and captured what then transpired on video.

The video footage shows Pagan screaming out, “I am not resisting,” and questioning the officer, demanding, “What are you doing?”

“We believe the video is very clear,” said David Rankin, Pagan’s attorney. Pagan, he contended, “was complying” with the officer’s directives, and he asserted, “None of this [the officer’s actions] was justified. We are calling upon the NYPD to respect individuals.”

Pagan was charged with “resisting arrest” and “theft of services,” the latter for allegedly jumping the turnstile to enter the station, according to Paul Browne, an NYPD spokesperson, who sent this paper the following email statement.

“The subject, who has nine prior arrests and one subsequent arrest, entered the subway system without paying, refused to present ID when challenged, and resisted arrest when the officer attempted to handcuff him,” Browne wrote. “He was charged with theft of services and resisting arrest. His previous and subsequent arrests included criminal mischief, intent to damage property; making graffiti, aggravated harassment by telephone, and criminal contempt.”

Samuel Cruz, senior pastor at Trinity Lutheran Church, said at the press conference that he thinks that “it is not tolerable to fear the police more than you would fear a criminal.”

As a “black and Latino man,” Cruz believes the community must address the issue.

“We are going to start policing the police. This could be my child. It has got to stop,” he remarked. “It makes me sad that our people have to live this way.”

Pagan, who works at a factory making clothes, said he is, “Kind of mad about what happened. I was shocked.” He spent 24 hours in jail and called his mom, alerting her of his arrest.

“She did not believe me,” the teenager said. “If it wasn’t for the video, nobody would’ve seen it, and I would just be another kid [who this has occurred to].”

Pagan, who looked down as the video was playing during the press conference, said that “violence doesn’t solve anything.”

What the hell are you talking about..?

Are you saying this police officers actions were justified?
How do you know WHAT lead up to the officer approaching the young man in the first place?

Also,you might want to pay attention to the news abit more closely..the perp who shot the child is in custody..

You might want to modify your righteousness for something worth it.
You really don't know anything about that young man to label him "scum"..other than the fact he had an encounter with law enforcement,which in and of itself is NOT A CRIME..

Why dont we see what the WHOLE STORY is before throwing people under the bus.

This is how it works nowadays with these punk-ass kids. Break the law, and if you're caught by the police, resist just enough in the hopes that the police will use reasonable force to subdue you, which in the eyes of random passersby, will always appear to be unreasonable, because they don't understand the context of what's happening. So they'll film it, and then the bleeding-hearts will cry police brutality. Oh my! Immigrants and minorities have to fear the police! The rhetoric! The politics! Look at how the kid's friends and random people all surround the officer and taunt him while filming it. They have absolutely no respect for police work, because they obviously enjoy breaking the law.

And then the punk-ass kid, who deserved what he got to begin with for breaking the law and then resisting arrest, gets to hold a press conference and feign innocence while his family no doubt starts seeing dollar signs in their eyes.

This is the disgusting new America we live in. You can't police the criminals. You break the law, you sue the police. Then a dumb-ass jury pays you.

I wonder what that loud sound was at the beginning of the video. That seems to be when the police officer starts walking over.

I've never in my life been a "punk-ass kid". *I* always prided myself on being mature for my age in school. Never hung out with bad crowds, and I've never been a criminal. I always respected adults and authority figures, and they respected me, because I never caused trouble.

I don't see how the people are taunting the officer. we have a right to record police activity so long as it doesn't interfere with the officer's work (which in this case it didn't). When the Cop was walking towards the camera man he moved out of the way and said "Im not interfering". The person also asked for the officers name which is also allowed and smart as to know who the officer is so that this video can later be used as evidence. I also don't see how you managed to get "They have absolutely no respect for police work, because they obviously enjoy breaking the law." just from this clip , as the bystanders did nothing wrong and were well within their rights to record the arrest.

On another note, although i think the officer used a bit of excessive force, he made the right judgement in arresting this person. If i was in that position of the crook i would try and be as respectful as i can to the officer and not be cocky as was the person being taken away.

Eh, in my view they usually go hand-in-hand. Maybe not a criminal per-se, but generally the type who doesn't respect the law, and will tag up a neighborhood mailbox or key a random car just for shits and giggles.

The first second of the video here had either a fireworks audio or sounds of other vandalism occuring WHILE the cop was running towards the perp. I think we have more than enough to throw the perp under a good bus, depending on what the dummy was charged with. The thug in the orange could have been charged with obstruction since on at least one occasion he blocked the cop and perp in custody while attempting to film, and the cop was WAITING for him to swipe at the badge. He should have been charged with public lewdness for having his "Pants on the ground".

I would have also locked up the guy in the orange shirt for OGA if I was the cop.

The kid evaded the fare, he got locked up. If he didn't want to get slammed to the ground, he shouldn't have held on to the poster when the cop told him to put his hands behind his back.

Absolutely, the officer's actions were justified. Whatever led up to it, the kid clearly resisted arrest. The officer used non-lethal force to take him into custody. As to the kid with the orange shirt, he was clearly trying to obstruct justice and I hope he's found and ultimately charged.

I saw this on the TV news. The kid definitely made an unexpected move while being frisked, and continued to fight with the cop after being "bodyslammed". Combine that with his record of previous arrests for subway hooliganism, and I have no sympathy for him.

I have felt for many years that the very FIRST rule of good conduct on the subway/bus is that you PAY YOUR FARE. Doing so is a sign that you have respect for the rules of society, while fare evasion shows you think you're somehow exempt from the obligations that are on all of us. It's interesting how many fare evaders are arrested for other stuff as well- drug/weapons, and some cases, serious warrents for other things. He fought the cop, he lost. TS for him.

No, of course not. This kid is obviously not in the same league as James Holmes or Jerry Sandusky. The punishement should fit the crime. That's why this kid gets a (deserved) smackdown and a summons- and goes home, while Holmes should be executed- or at least locked up in a "special housing unit" 'till he's 88.

Jerry Sandusky should be made to stand naked in the general population prison shower forever.
