NYPD Supports Subway Photographer

I was out cruising the V Train on Friday afternoon for a few digitals.

While at Rockefeller Ctr. southbound, there was a ruckus on the northbound side between an Asian male toting an SLR camera and a black male who was evidently a passenger waiting for a train.

The passenger, stating that he was an "American," loudly rebuffed the photographer's attempt to line up for a shot of an approaching train, imploring to one and all that "YOU CAN'T TAKE PICTURES IN THE #### SUBWAY, OR YANKEE STADIUM OR ANYWHERE." The photographer retorted that he certainly could. The passenger reiterated himself, growing slightly physical, the photographer stood his ground.

After more loud interplay, the photographer went up the stairs and located two officers. Out of sight, he informed them of the situatiion and asked if photography was still legal. He was informed it was.

Back downstairs the ugly exchange continued, until the two officers finally arrived on the scene. The passenger pled his case, the officer quoted the law, and the photographer shrugged. Two trains (a D and a B) then blocked my view. After they passed, the officers and the passenger were gone, the photographer was finishing up (presumably after getting the desired photos) and making much more pleasant conversation with another passenger.

And so it goes...

This person needs to get a grip if he felt"threatend" he should have went and found a cop instead of opening his mouth and talking about stuff he has no idea nor clue of...

Kudos the the guy with the camera in keeping his head...

Kudos to that photographer for doing the right thing, not losing his cool, and dragging the right people into the situation. Thanks for the story.

IAWTP A few weeks ago I was on an R160 E train and I wanted to get a pic of the car# but this guy got up blocking my view and told me I cannot take the pic and I stood up and said that by law I can and if he had a problem with that to get a cop otherwise sit down and shut up, which he did and I got my pic:)

Although, I probably shoudl have been more cool about it but I felt he just needed someone to stand up to him rather than delaying the train for the cops to come

Wow, it looks like the NYPD must really have gotten the word through to the cops on the beat about there being no law against photography, if they're even standing up for photographers now.

When a cop helps a photographer who's getting harassed, everyone says how wonderful it is, and it is a good thing, but that's exactly the point.

When a photographer is harassed by a cop, any mention of it provokes a flamewar between the three general factions— the people who think that action ought to be taken to prevent it from happening again and that the photographer should file a complaint or lawsuit and not take it lying down, the people who think it was all the photographer's fault and he should stop invoking constitutional rights and thinking independent thoughts and not do things that might bruise the officer's massive ego, and the people who believe that harassment of photographers is a necessary and/or good thing and that the photographer should put his camera into storage until the government decides it's permissible for subjects to take pictures again and be glad he wasn't locked up like the evil Enemy Of The State he is.

Oh, great. I just spoke the truth to SubChatters. You know at least three of them are going to be offended and turn this into a massive flamewar. Well, at least it might hit 10 pages now! :D

Anyone who posts regularly has seen a flamewar erupt in a thread they started. My "misinformed t/o" thread burst into flames after one of Terrapin's posts.

A company I once worked for used to explain customer relations like this:

If a customer has a good experience he may tell one friend, but if a customer has a bad experience he will tell 10 friends.

With the internet bad experiences now spread even faster and wider.

Perfect analysis of the photo rights debates going on over at all the photography groups as well. You would think that photographers would be united on this issue but they too fall into those three camps. Studio and wedding photographers who think that the camera belongs in a studio don't care for the rights of "street photographers", etc.

I would add a fourth category:

Those who simply don't care either because they have not personally experienced the harassment or only take pictures - ad nauseum - of their own family and friends and again don't care about the rest of us.

Or, in my case, I had an exceptionally good experience (on Amtrak, so it's on-topic) and wrote a complimentary email to Amtrak. I got an email back thanking me for the kind words. A month later, though, I got the standard "unhappy customer" form letter in the mail, along with a voucher for future trips. Erm, thanks, I guess? I don't know, it was just kind of funny.

Mr. Rosa:

The photographer was Asian-American, not a Japanese Tourist. Matter of fact, at one point during the exchange, the black male was fairly screaming "I'M AN AMERICAN AND A ####IN' NEW YORKER AND I KNOW YOU CAN'T TAKE PICTURES IN THE #### SUBWAY!" The Asian male responded "I'm a New Yorker, too, and I know I can!"

I wondered if he might be a contributor to this august domain, which was one reason for the initial post.

As defined in the Gothamist, our antagonist was indeed an "ordinary busy-body."
