ANOTHER Police Encounter.

I recently had another encounter with ignorant misinformed cops who should have their badges removed and recycled for use as trim on the front of an R179. I'm a little late posting this (although I alluded to it earlier in another thread; didn't want to hijack it all the way, so I'm making a new thread now). I hope I'll be able to get another R32 on the F— I'd been taking RFW vid, and due to the aforementioned officers, I was unable to complete it end-to-end. :(

Oh well. My dad works downtown; I can go out to lunch with him when I go to the CCRB. I estimate it'll be about six months to a year before I'm on a first name basis with an investigator there! *groan*

This is getting utterly ridiculous:

Obviously, they are misinformed, are paranoid, deal with paranoid people a bit too much, or have to deal with supervisors who may be paranoid or overly security concious, or some combination of all of the above.

That's the problem since 9/11. We are dealing with too many people who have become paranoid since then, especially since the bombings in London and Madrid as well.

Oh. I totally believe it. Ever since my incident at BROAD CHANNEL (probably the LAST place that would be a target for terrorism, and one of the FIRST places a nature photographer would go) in 2004, I fully believe that some MTA staff/NYPD have absolute no common sense at all when it comes to who is suspicious and needs to be questioned, and who is going about a harmless hobby.

Thank you. Although it wouldn't particularly bother me if SubChatters didn't believe it. I've got the video proff for where it counts.

I might get around to posting it at some point, but Photobucket only allows 5 minute videos, so I'll have to find alternative hosting if I am to display the video.

Anyway, I got a summons ($25 fine) for "violation" of NYCRR 1050.9(c)— taking video without a permit.

The officers violated 1050.9(c) by NOT letting you take the video - too bad they cannot be subject to citizen arrest!!!

I believe Youtube allows for longer videos - you can edit it down to the relevant parts.

Did you write to the NYCLU?

Using a big and bulky camcorder should reduce the idea of him being suspicious since he would obviously not be trying to conceal anything.

Probly knowt, but the ossifer has to write *something* and hope that you will not take it into court. But now you have the ossifers name and badge on a peice of paper, and your lawyer can pursue that. Most ossifers will not show up at a trial. Your lawyer can compel him to do so.

Rambo would know how to handle this. He was confronted by police in Rambo: First Blood, and they were mean to him, so he was mean back, but they tried to sodomize him or something, Rambo doesn't like being sodomized, so he unloads on the BAD cops..

But it is no longer surprising.

There must be *something* about Nilet that lights off suspicions for these officers. Maybe the wrong haircut. Maybe the wrong attitude. Maybe the wrong Mother and Father. I cannot tell.

But none of that matters, he is clearly in the right and they are less so.

My younger brother *always* got in trouble driving my parents car.

17 year old punk looking kid, diving a Mercedes. Yeah right, pull him over and check him out. This went on until every officer on the beat knew who he was and what car he drove. Fortunately Merrick did not have as many officers assigned to it as New York City has.

Things were a bit slow over the winter but photographer vs. cop/security encounters are on the rise again across the country. All the photo site bulletin boards are full of stories this month.

Youtube allows for 10 minutes of video but no more than 100mb's of video. But I believe you can ask youtube for permission or something if you video is lonjger than 10 mins. or 100mb's.

Funny if he gets locked up for doing something legal, They will be a A1 class lawsuit! I doubt he is doing nothing more than tacking a pic or shooting some vid. But from his previous encounters, The cops seem to see him coming.

Cops wouldn't charge him with something legal. They'd have to release him right away because their lieutenant would tear them some new back doors. If they took him in, they'd have something to charge him with.

Nah..what they do is hit you with some B.S charge..

Like Disturbing the Peace..Disorderly Conduct....Theift of services...Something that wouldn't have ABYTHING to do with WHAT THEY APPROACHED YOU FOR.

Thats how they get you...

So your best bet would be to BE POLITE..answer questions that deal DIRECTLY WITH THE TASK AT HAND..and if need be, show FACTUAL INFORMATION STATING THERE ISN'T A LAW AGAINST PHOTOGS taking pics on MTA PROPERTY,unless its a secure location.

The difference here is "incident". You haven't been stopped multiple times, like Nilet has. Something else is going on.

Well they already did something like that. They gave him a summons for violating 1050.9(c) when 1050.9(c) specifically ALLOWS what he was doing.

I don't think he is provoking the cops. I've been with him while he takes photos and video and he doesn't provoke anyone. He just takes photos and video. The cops are instead targeting him for whatever reason.

Disorderly Conduct is also specified in the Transit Rules. LOOK at them, you'd have to be a real asshole to come up to that criteria of conduct.

It is not disorderly just because some cop doesn't like it.

I believe him because of what is happening to photographers all over the country. Note that the cop gave him a ticket for "videotaping without a permit" - video is clearly allowed by 1050.9(c).

As for detention - some photographers have already been detained for questioning and have settled for several thousands of dollars:

A filmmaker who sued the NYPD and won

If NYPD wants to waste more taxpayer dollars then by all means arrest him....

You don't go to CCRB for a summons. You go to court for a summons. CCRB won't even take it unless your complaint includes discourtesy, physical abuse (brutality), abuse of power, etc. (Also,if the complaint is for corruption such as asking for a bribe not to write a summons yo go to internal affairs, not CCRB)

The ten minute limit was imposed fairly recently under Google's management. Longer videos that had been posted before that policy were grandfathered.
