Is it frivolous, or is it based on some kind of principle that a government agency is allowed to make reasonable judgments, which may not benefit all people?I can imagine that one could come up with real evidence that of two essentially comparable apartments the same distance from a subway station, the one near the express stop has higher value. But a court might still rule that the case can't go forward because the government agency used its judgment to try to act in the interests of the people as a whole. This wouldn't necessarily mean the case was frivolous. |

That is a temporary and unavoidable shut down for rebuilding, as has happened to the Franklin Shuttle, and will also happen to the Myrtle Ave M line, not a permanent degradation in service, which is what the Hillside Ave local stops had for a while with the R in the late 1980's.We also know the TA has never known how to run the R service reliably. |

In order to sue and survive a motion to dismiss by the defendant, the lawsuit must be based on some existing legal principle. IOW, there has no to be some statute, constitutional provision, precedent, etc. based on which you are suing. There is none here. Now, I could be wrong, and there could be a valid cause of action, but Mr. V has not stated it. |

They also mention the LIRR taking 17 minutes.There are several references to the locale of the express subway stops and the LIRR trip time. So trip time matters in selling real estate. Swap out the E or F for the R, and their commute time climbs 10 minutes, or they transfer at FH, adding to trip time, to resume their express train journey. They can claim they lost a selling advantage, took too long to sell, and had to lower the price, or else their property did not go up in value as much as it could have had they not messed with the service. Your house overlooks the bay until they build something tall between your house and the bay. Your house is one block from the supermarket until the supermarket goes out of business. They can't sue the supermarket for going out of business. If there is community opposition to modifications in subway service, that's one thing, but the realtors have no case. |
