Is it frivolous, or is it based on some kind of principle that a government agency is allowed to make reasonable judgments, which may not benefit all people?

I can imagine that one could come up with real evidence that of two essentially comparable apartments the same distance from a subway station, the one near the express stop has higher value.

But a court might still rule that the case can't go forward because the government agency used its judgment to try to act in the interests of the people as a whole. This wouldn't necessarily mean the case was frivolous.
