There's also a documentary about him coming out next month...http://www.offtherailsmovie.com/#STORY I wonder if the TA will let the film studio use the museum cars for the flashback scenes? In other articles about this movie if was said it would be a lot of flashback scenes of him stealing transit vehicles... Also think its absurd the TA wants the money that Darius will make from this movie. |

So what you are trying to say, in a convoluted way, is that you think a public agency being the recipient of the income is different from an individual person or persons? If so, based on my reading of the article, and without knowing the particulars of the son of sam law, I don't see why they should necessarily be so different that this would become a test case. |

"What is so special about this situation?"I think unique would be a better word instead of special. To the best of my knowledge, there has never been a case where an individual swiped trains & busses then have a movie production made from it, then have a municipality go after the movie profits based on his felony(s) convictions & the Son of Sam law. In that sense, this would be a test case. |

Sort of playing a devil’s advocate here, it’s possible that the money could be put in some sort of a trust for Mc Cullom’s family and if the movie company is outside NY state, the MTA may not have any legal standing to compel enforcement of a NY law outside the jurisdiction of the state. |

What's terrible about the Conqueror is that all the location shooting was done very close to a place in Utah where there had been heavy atomic bomb testing, and they brought back a lot of soil to the studio. Almost everybody involved with the movie- cast and crew - ended up dying from very virulent forms of cancer.Which brings up this on topic point - where are they going to shoot this? Certainly the MTA won't let them any where near their property. |

Working on that dirt was not a great idea, especially if it was an indoor set (thus the dirt doesn't get sloshed with occasional rain). But in general, about 40% of people will get cancer. Among the movie's crew, the cancer rate was a few points over 40%. Inhaling the powdered form of something (dust) is a great way to enhance its hazard. The telling fact would be not if people got cancer, but comparing their age at onset and the types of cancer with the general population. |

Test case; From Webster,"a case that sets a precedent for other cases involving the same question of law." Since no other case with these specific particulars like this has been brought before the bench, no precedent exists (Son of Sam law being applied in a situation here) thus by defination, this would qualify as a test case. |

I know what a test case is.And as I told the last guy, that reasoning is invalid as almost every case would be test case under your reasoning. What I want to know is WHAT SPECIFICALLY ABOUT THIS CASE WOULD MAKE IT A TEST CASE. HOW DO YOU KNOW IT WOULDN'T BE AN OPEN AND SHUT CASE? WHAT PART OF THE WORDING OF THE LAW OR THE PAST APPLICATION OF THE LAW MAKES YOU DOUBT THAT THE MTA EASILY QUALIFIES AS THE VICTIM? |

Legitimate transit employees have in some cases done more harm than Darius will ever do. I think that the point being made is that since this would be the first incidence of an attempt to recover it would be a test case. If a previous victim had sought to recover, then that would have been the test case and not the one involving the MTA. While not a definite, the first attempt at enforcing a “new” law in effect becomes the test case for any subsequent actions. |
